In Spain and no fault accident / third party only

Hi All,

I have a "challange"... I took out fully comp. motor insurance in the UK but have been in Spain since December 2010. Last week someone ran into the back of the car and subsequently signed something to say he was at fault but when I contact my insurance I am advised that:

1. After 3 days abroad I only have 3rd party (didn't realise this...)
2. Apparently this means that I can not claim via my insurance
3. I have to either pay for the repairs myself and then my insurance company will help me sue the other persons insurance company or I need to claim through the guy who hit me's insurance?

No real arguement about having third party (my own fault I guess) but I find it odd that I have to contact someone elses insurance company rather than my own? Is that normal? Any advice on how I can get my car repaired?

    If you in effect only have 3rd party insurance, they will only pay out to a third party. ie not you. Your legal cover may help though.
  • Ok- but does the same apply with the other guys insurance (ie - should I expect that they would pay out to me assuming he is at fault)?

    Yes, if you have an uninsured loss recovery on your policy, speak to them about it.

    Only issue is how long are you staying away? Insurance companies are not renowned for their speedy service.

    If your car is being repaired it may take weeks.

  • Just so I am clear (I'm a little thick today!) if I have just third party motor insurance and someone runs into me in the UK (and assuming they are at fault) do I contact my insurance or thier insurance to get this fixed? Or do I need to foot the bill myself and then claim it somehow?

    Contact your insurance and they will say thats nice, Thanks for letting us know have a nice day.

    You contact their insurance to get the car repaired by them or get quotes and agree a settlement
    figure which could be the bill to repair it or replace it. You may be offered a settlement where you
    keep the car.

    You must let them inspect it before any repairs are done. If you repair it and they disgree then you may
    not get paid out without a fight.

    3rd party is just to get you legal, It pays for any damage you do to other people/property. Fire & theft
    extention will only payout if its stolen or bunt out (providing you didnt arrange it of course)
