Tax rebate problem - on benefits but not

I really just need to know who the best people to speak to are and a phone number if possible.

Ok here's our problem.

I managed to get a lovely tax rebate before Christmas thanks to MSE because I had been over paying for the last two years.

I know my OH was on emergency tax for 2008/09 and 2009/10 (whilst working as a temp) so I had been nagging him to make a phone call. After all it was easy for me.

In Oct 2009 one contract ended (as he'd been a temp in the same company for a whole year) so he made an application for JSA. However he was offered a new post very quickly and they asked him to start the day before he was due to go in for his JSA interview. Naturally he phoned up and told the job centre who cancelled the interview and told that was the end of it.

He phone up HMRC yesterday and was told that as far as they can see he has been on benefits since Oct 2009 and that they can't do anything even though they can also see he has overpaid for two whole years.

They told him over the phone that he should contact 'the benefits office."

I don't know if they mean the job centre or the DWP and they certainly didn't give him any information on contact details.

I'm really stumped for where to start as we've had very little to do with benefits in the past and certainly haven't been receiving any money. We don't even qualify for tax credits because we're too young!
