    All very strong words Baza considering that no one is ever more than 2 rent cheques away from homelessness. What is the issue with your daughter taking a payslip down to the benefits office? You need never know what she earns and the government already do through HMRC.

    I have a secure tennancy with a HA so it would take a lot more than 2 months.

    The issue is, its none of their business what she earns.
    Why should i make her provide personal info that is completely irrelivant to the claim.

    I am entitled to full HB/CT regardless of who else lives here.
    Thats a fact you cant disagree with

    So, does anyone actually have any answers to my original question rather than their thoughts on the subject?

    "Is this going to be a straight forward review or does anyone think the fact they have asked for daughters wages which we will not supply it may scupper the claim in any way.
    They havent asked for an update on my sons wages or anything."

    ok here goes.
    up til 7 years ago i lived in a rented property. i receiving DLA. my daughter and son in law (both working) moved in with me. even though i too was expempt from council tax, both my daughter and her husband had to prvide wage slips, before we were told their income was no included. ( i didn't know this at the time, and we submitted the wage slips thinking that any entitlement would partly be calculated with this information)
    we then received a letter (which i queried) saying i was still entitled to full benefit.
    no hassle. no fuss.
    as i said previously..its up to you how much bother you want.

    I would say that housing benefit have a right to request you to provide information in accordance with regulation 93 or 95 (not got them to hand!) and the fact that your wife is on DLA does nit mean you are under no obligation.

    However, the LA can apply a max income for a non dep which would normally lead to a high non dep deduction.

    If they wish to review the case, you can confirm you will not provide the information regarding the non dep and they can carry on with the rest of it

    But that is your experience not factual.

    When my son left education and started work we notified HB/CT.
    At no point did he have to provide proof of his earnings as my wife was in receipt of HRC.

    Being in receipt of HRC is all they need to know, you may have been told you had to submit their wages but they were wrong to tell you that.

    It wasnt a requirement when my son started working and neither is it now my daughter has.

    Just becasuse your told something it doesnt make it a fact.

    Can I ask how old your son was when he left education as if under 18, his income wouldn't matter

    he was 18 at the time.
    Left education then a few weeks later started work.
    That was 4 years ago.

    Daughter was also 18 when she left and started working the following monday :)
