Car insurance claim

Hi, I apologise if this is something that has already been discussed, but I have loooked and couldn't see any advise. A car hit us last August and dented the rear passanger side. It was the other drivers fault to which he admitted to us at the time. We also had a witness who has completed a statement to verify the incident. We haven't had any assessors round, which I am not sure is normal. We have also continuely chased our insurance company for updates. Originally, they were waiting for for the witness statment, which they received in October. The point that I would like to know is that having spoken to our insurance company last week, they have now said that the driver who hit us, although insured, has ignored all correspondence from his insurance company and unless he fills out the relevant documents and admits to the accident, we can't do anything about it.

Is this true? Does the law favour the guilty party, or can I take this further?

    I don't have an answer, but have a similar problem that I need an answer to.
    My accident was LAST JUNE!!!. I was hit head on by a motorbike, coming towards me on the wrong side of the road. He was foreign, which, I think, is causing a lot of the problem.
    My car is on a pcp deal ( which is new to me) so I contacted the garage I bought it from, to ask their advice. They suggested getting their own specific audi approved garage to pick it up and fix it, which they did. I had a courtesy car from them, which all went fine.
    Unfortunately, my insurance was due in July, and because the claim had not been processed, my premium went up by approx £80. I was assured that this would be reimbursed once the claim had been resolved. I also paid my Excess for the repairs to the car. (£150)
    I phoned my insurance company around october time, to see what was happening. Claim was ongoing, I was told.
    I phoned again in January, and was told that my insurance company was no longer involved in the claim, because I had lodged a personal injury claim with another solicitor. ( I HAD NOT)
    Since then, every time I have phoned , (which is several) I have been given the runaround, or worse, cut off. I think 8 months is more than long enough to wait for reimbursement of my excess, and reinstatement of my no claims, which incidentally, is protected, at further cost to myself!!!
    The other solicitors in question, have been hired by accident exchange to recover uninsured losses from the car hire charges from audi, and are not in any way involved with me, so I have no idea where all this came from.
    Can anyone advise what my next step should be? I am tearing my hair out!!!
