need help urgently about car claim

hi
my partner was involved in an accident where the person driving in the first lane under took her and and cut the car off. partner tried to avoid the car and end up hitting the central barrier and spinning out and the car ended up on the grass onthe side of the dual carriridge way where the car was half on the grass and half on the road. called insurance company and there approved car garage took the car away. advised by them the car was fixed so i picked up the car. after collecting the car i could hear noise from the back of the car and the car was not braking properly. i phone the garage straight away and was told to call the insurance company which i did, and had a call back from the car garage to bring the car back in the following week. took the car bck to them a week later for a road test and advised they will fix the issue. got a phone call back to say the car is not roadworthy. so the car gargage gave our car back to us with making sure nothing else was wrong with it. so we had the car for a week which is not road worthy. the insurance company are not helping at all going from one dept to another and the complaints process does work too. the insurance company said they need to get a independant engineer out to asses the car. had a call back from the car garage who are refusing now to repair the car .... need help from someone to knw where i stand about the car garage who failed to spot the damage on the car ... plse can someone help me as the insurance company are nw tryin to fobb in off and saying the damage is not acccident related

Why did you collect it from them if they told you it still wasn't roadworthy??
Are they now saying it may not be economical to fix, and could be written off?
If it's not roadworthy and you can't use it you need to be escalating this with your insurer. Ask to speak to a manager to get things moving.0 -

Now lets try and help your question...
It maybe a mechanical fault with the cars brakes. When was the car serviced last? How many miles ago?
It may have been a factor in the accident.
The insurance wont cover mechanical neglect. If the brakes turn out to be badly worn then they wont pay out for
those repairs. If they decide that was the cause of the accident?Censorship Reigns Supreme in Troll City...0 -
Thanks for your reply. The insurance company are saying the damage is pre accident.I have got my local garage to look at this and advised me that the damaged was caused by accident. i have paid for the repair and now looking at claiming the money back from them. I refuse to call them as I get now where as either they fob me off or don't return my calls. Even speaking to a manager does help. The garage did say the car was unroadworthy. Do you think I will get refund of the repair work which has been done or used I take this to FDA n report the issue ????0

not always the case, what if the right hand lane is marked for ahead/right and left hand lane for left only and the car cutting across realized they were in the wrong lane?
happens all the time on the bypass near me,
but your right with the middle lane hoggers on motorways :mad:
also very irresponsible of the garage if they knowingly let you drive an unfit car away especially if the brakes are faulty or did you have it towed?0
