What am i able to claim??? Due to injury after accident(Bit of a long post SORRY!!!!)

I am currently in receipt of child tax credits and income support and my partner gets carers allowance 4 caring 4 his father and i am wondering if i am able to claim any benefits due to the fact i had a fall on some broken kerbing almost 2yrs ago which lead to me having a metal plate and 2 screws put in my ankle but i am currently in the middle of claiming compensation from the local council but since the fall/accident i have suffered mentally & physically and now have difficulty walking after about 10minutes as i get severe pain in my ankle sometimes up my leg and sometimes my ankle sometimes just gives way which causes me to fall over also when i ecently attended the medical for my claim the consultant/surgeon thinks i may need yet a further operation to correct my ankle allignment after already having had 2 operations previously and after chatting with a friend they said i may be eligible for some kind of benefit or mobility allowance also due to my ankle giving way sometimes i am scared to go out alone so feel i need to have someone with me!!!Does anyobe know if i am eligible for any type of benefit and if so what Benefit????

    So both you and your partner are in receipt of benefits? No one in your household is working? Are you now looking to claim DLA in addition to your other benefits? Perhaps a nice car? Did you discuss your intention to make this claim with your consultant? If so, was he supportive? Does he agree you need additional help?

    Just one thing caught my eye. Why not get a stick so you can support yourself and then if your ankle gives way you won't fall over and damage the ankle further. Your consultant must have suggested this, surely?

    if you're completely unable to work you can claim Employment Support Allowance. If you have enough NI contrubutions you won't be income assessed but if not your income may be too high though it can still be worth claiming as you can receive N.I contributions.
    I cannot see you getting DLA if you able to walk but it may be worth applying.
    Remember you need to inforn IS ans Tax credits of your change in circumstance.

    Are you aware that should you claim any benefit this amount could be re-couped in full from your compensation claim by the Compensation Recovery Unit. Talk to your solicitor about this.

    Benefits would only be affected if the OP is receiving the benefit because of their accident.

    Op , why are you receiving income support ? Is it because you are unable to seek work because of your ankle problem ? If the answer to this question is "yes" then im afraid that before you even receive any cheque for compensation , your benefits will be recouped from the amount payable.

    If however your benefits are paid to you for a reason totally unrelated to your ankle problem then you will not lose any of your compensation.

    Just remember though that if the compensation you receive for your accident is off a substantial amount your entitlement to income support may well be affected any way.

    Will the OP need to inform the benefit department regarding amount of compensation or is this only for certain benefits.

    It will depend on the tye of benefit she is in receipt of at the time of payment of compensation.

    If she is on income support, income related jsa, income related esa, housing or council tax benefit etc then yes, her claim could be affected depending on the amount of compensation.

    The ops comment re claiming benefit as a result of the accident eg -

    is quite clear. The op wants to claim DLA purely as a result of the accident and therefore the claim is subject to CRU

    ''i have suffered mentally'' You fell on some broken kerb?? My niece of 11 at the time did this she is fine now not a problem and her family are not claiming she is ''scared to go out''.

    I'm in support of anyone claiming because they REALLY need the help but I honestly think, just my opinion your taking the mick.
    The day I had my Beautiful son is the day everything came together for me. For someone so small he done so much and made me complete.
