Incorrect PCN code????

hi there
my mother in law parked her car in a disabled bay and displayed her badge correctly but forgot to put the time, so she got a PCN but on the PCN the code was put as Parked in parking place or area not designed for that class of vehicle (code 23)
i responded to the council and they wrote back with photo evidence of the wrong time being displayed on the time clock and a sign saying there is a 3 hour limit on disabled only. also the car correctly parked in the designated disabled bay...
so as i see it the contravention did not occur as she didn't commit a code 23 but she did commit a different offense by not displaying her time clock correctly
if anyone has any info on this i would be grateful

It would indeed seem that it's the wrong contravention. I believe either code 35 'Parked in a disc parking place without clearly displaying a valid disc' or
36 'Parked in a disc parking place for longer than permitted' would be more appropiate.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -
Code 23 is designed for things like a car in bus\taxi stop and refers to the actual vehicle so definately incorrect. Parking in a designated disabled bay without displaying a valid B.B is code 40, most designated disabled bays are unlimited parking unless otherwise signed. What does the signage for the bay say0

Sorry just re-read post and you have stated parking for 3 hours was signed. I would still definately formally challenge the PCN as the code is incorrect0
