moving out in 4 weeks- un-signed inventory.

hi, ya i am moving out in 4 weeks, the managment by the letting agent has being very poorly, that proorly that the inventory for the house was send to us last december, we haven't signed it, as we have been living here for more than 1 year.. and they just wrote that they just noticed they havent given the inventory to us and please sign it and send it back

When we moved in, the landlady came around after few weeks and took few things from the property, gave us the microwave and asked us to give the old carpets away. althought there is writting proof of this, she just said that to us, cos we told her we wanted the house unfurnished.

the have arranged for people to come over and see the property tomorrow, there is a mold problem in the toilet, that they masked when we first saw the property, and now it became very apparent as the toilet and my daughters bedroom's cealings are covered in mold, i have to cleaned , it is better but not gone. I guess i am worried about the letting agent to try to retain our house deposit. I am still waiting for somebody to come and repair the awful smell that is coming from the shower-( told them 2 weeks ago).

The kitchen is very old, the main oven never worked and the top oven just given up, we did not care as we only use the grill, this is not stated in the inventory- although we never signed, i am guessing i should make the people aware tomorrow when they come.

Is there anything i need to be aware to make sure i get my full deposit back ?

  • If the inventory is and still is inaccurate then I would make amendments to it to reflect reality. If I was minded to sign it now after so long, which I am not sure I would. Just because there is a written list does not mean that there is any proof that it was and still is accurate unless the landlord or their agents have dated photographs from when you moved in. In a tenancy deposit dispute the onus of proof lies with them, not you.

    If you believe that the landlord has painted over the walls to mask the damp and mould I would consider doing exactly the same in the time you have left before you leave. Any comments or observations from the agents about the state of the property now, before you actually hand it over, are irrelevant.

    I would most certainly point out to them that the appliances don't work and never have and I would also ask them why the landlord has chosen not to address the problem with the shower. If it smells and you don't want to get the blame for it you should clear the outlet of and hair and debris and then put some washing soda down there and follow it with a kettle of boiling water. Then bung some disinfectant down.

    I dunno what to advise you about the carpets you have disposed of but I hope there won't be a problem as it appears your permission was given only verbally, so perhaps the landlady won't lie about that. Here's hoping!

    Normally, you are legally obliged to return the property in exactly the same state that it was at the tart of your tenancy, so no dirt, marks or stain anywhere. I suspect you might be a fairly good position because of the lack of a dual-signed inventory.

    You should have received notification from the agent or the landlord about which of the three deposit-protection schemes your deposit was registered with. Can you confirm whether that is indeed the case?

    Yes, we are with DPS, we rang them asking for the repayment ID as The Property People need it to process with the deposit once we move out/

    The shower seems to be blocked, i tried my best to un block it, but still takes ages to drain the water.

    I take it that The Property People are the Letting Agent?

    You should NEVER EVER give your repayment ID to the Letting Agent or the Landlord. If yu do, then they can accept deductions in your name. This ID is solely for your use and is not divulged to the Letting Agent to protect you. If you have already given your ID to the Agent, you must write to the DPS immediately [a proper letter] and say that your ID has been compromised due to deceit by the Letting Agent and that you require a new ID. Keep a copy.

  • The washing-soda and boiling-water trick may work on a blockage but it depends on what is causing it. Use about half a bag of the stuff: it costs less than a pound at the supermarket. If the cause of the blockage could be attributed to you not clearing the drain with hair and whatnot you should do this before the agents turn up

  • I can't believe that an agent who has won awards as the best one in Wales two years running would put an illegal request like that in writing!

    In any case, do not disclose that Repayment ID number to anyone, not even your granny. When they turn up tomorrow you could ask why they think they need it. This could provide them with a clue that you are not someone who knows nothing and therefore cannot be messed with. Which you can't now that you can get advice on here

    They need it to process the deposit as much as they need your bank card pin to process your deposit!

    Ooh! Yummy! Scan it, delete your personal details, post it on a hosting site and give us the link.

    Seriously, if they are asking for this in writing, you need to put the letter up to help stamp out this kind of thing.
