chargeback advice needed please

hi i brought an item which was posted on october 3rd from america via surface mail i havent recieved the item yet and parcelforce say that it hasnt arrived in england yet. I have emailed the seller and they said that when they next go to the post office (next week at some point) they will find out what is happening as we dont have a tracking number just a customs number

my question is that tuesday will be the last day i can do a chargeback but obviously i cant do this as i dont know if the item is missing or not and could just be delayed but if i dont do a chargeback and the item does go astray i will have no comeback and i really dont know what to do
the cost is only about £30 but obviously i cant afford to lose that and have no item
please help as i know i am probably panicking and there is still time for it to get here but dont know if i can do anything after the date of final chargeback

i hope that all makes sense lol any help would be greatfully recieved
thans tracey

Surface mail can be extremely slow. It was pretty daft of the seller to despatch that way.

Why do you think you only have until Tuesday? I understood it's 45 days to open a dispute.

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

The only way to protect your money is to do a chargeback, if you let the 45 days go past you have no way at all of recovering anything unless you have a credit card to fall back on.

As your item hasn't arrived, and assuming it was sent airmail, they your seller should be pulling out all the stops to help you in tracking it down.

Sorry, I just read fay's post and realised the item was sent surface. That is a whole new problem as it is unlikely to arrive before the time limit for a chargeback is up. Your only option really is to put in a protective chargeback as late as you can, there is no extension due because of the postage method. Personally as a seller I would never use surface mail purely because of this problem. You could try explaining to the seller why you are doing it and assuring her that as soon as item arrives you will cancel the chargeback.
