Being chased for an 11 year old debt

Would appreciate some help here guys.........

Received a letter from Cabot Financial at end of September last year stating that they had bought the debt from CitiFinacial that I had £1242.87

I called them and said i did not know what they were on about and genuinely could not remember anything from them.

Received a further letter saying it was for a credit card i had taken out on 19th March 1997, and defaulted on in October 1999 with an amount of £2825.23. The last payment was for £40 on 31 May 2000.

Cabot purchased the account on 2nd September 2010 with a balance of £1242.87

I have not received anything on this for years and as you can see the last payment i made was over 10 years ago..........

I have a feeling there is a 10 year rule somewhere, but am totally unsure how to proceed.........

Would appreciate any advice you can give

    Assuming there is no CCJ for this debt then based on what you have posted it would be statute barred - see here for links to factsheets and templates - Statute barred debts and the Limitation Acts

  • there is certainly no outstanding CCJ now for this. cannot remember if there ever was one tho, i dont think there was

    Under the Statute of limitations (Limitation act 1980) assuming you have not acknowledged or paid towards the debt for a period of more than 6 years, then the debt is deemed 'Statute Barred' and cannot lawfully be collected.

    I'm not sure if there is a letter on here that you can send to them in this situation, but other websites, such as the Consumer Action Group, will have on their forums a template letter you can send to the debt collection agency.

    If there was a CCJ and you didn't clear (satisfy) the debt, then it will still be valid. They don't just "disappear" like defaults - they can be reinstated.
