Section 20 - Consultation on Major Works (Leasehold)

Not been around for a while, but perhaps someone will remember me and take pity! :p

We have just received a Section 20 Notice, the initial stage of consultation. I am delighted as resident-leaseholders have been complaining about the state of the common parts since 2006! :eek: The present freeholder was once our caretaker, and it is clear he and his wife are very much learning on the job; however the S20 appears to be largely in order, and I am part way through a letter making formal observations.

My memory is that the freeholder has the responsibility to consult and be mindful of any representations but NOT to get the agreement of everyone or even the agreement of a percentage. This is key because the vast majority of the flats are let by absentee landlords. My mother seems to think it's 100%, however she has a share of freehold. The caretaker's wife seems to think it's 50%, however they have got the legislation wrong before. :( However, the Leasehold Advisory Service website is overhauling the leaflet I want, and I can't find confirmation on Google or elsewhere on the LEASE site. Does anyone know for sure? I don't mind researching plain English but prefer not to have to read the 2003 Act itself. Plus my left mouse button is fooked.

Secondly what happens if leaseholders support some parts of the S20 but not others? For example, I support re-carpeting but I don't want fitted carpet to be replaced with carpet tiles. I support painting but I don't want a £250 plant. :rotfl: Does the freeholder have to start the process again if there are major changes to the proposal? They have already obtained estimates, so it may cause problems with absent leaseholders if that massively increases because residents request like-for-like carpeting.

Sorry that's a tad rambling, my brain is running way faster than my fingers. :o

    Awww, thanks ladies you have made my day. :o I'm doing pretty well considering ... my meds have changed so the insomnia is vastly improved, bank balance slightly less healthy after a good dose of hypomanic shopping. :rotfl:

    How is the job hunt (B&T) and the landlording (Clutton)? And life generally (both)?

  • Job-hunting is going a keenly as ever but not getting the result I want. Or any results, come to that. However, there is an upside: my home is the cleanest it's ever been. And I've taken up baking to pass the time.

    hiya - hope the sleep gets more regular and deep.... i had a significant course of acupuncture recently... cracking results... utterly cracking..... i would recommend it to anyone....

    landlording is as it ever is... trouble free for ages.. then it comes in threes !

    its trying to persuade old boilers to keep going another couple of years at the moment... flushing out pieps and old radiators and boring things like that ... but i am so grateful, all properties occupied, all tenants paying - mostly on time... so life is good

    Maybe we should trade lives? You can have my min wage job and my (filthy :o) flat for a while. Baking is better than boozing, can you sell your products or use your cooking skills in some voluntary capacity? Are you getting any real help from the Jobcentre or are they at a loss as you are skilled/ experienced?

    I'm glad to hear your tenants are behaving, that has to be the worst potential source of stress?

    I'm not getting to sleep as early as I should, but I sleep long when I do crash out and it's more reliable. Plus I've lost much of the weight I gained on the old meds. :D The audible hallucinations are worse (music due to meds not scary mental stuff) but that's only at night so it's not a big deal. Never thought about acupuncture, considered hypnotism but nobody that knows me thinks it would work! :rotfl:

    If Paul McKenna can subliminal message people to rob a Securicor van then perhaps your mate can hypnotise you to get a job! Or at least teach you to hypnotise potential employers? You could blag your way into MI5 and sell your story to the News of the World. :T

    Jobcentre fooked up my money too, apparently I have defaulted on my council tax and still have the same amount of savings as before six months on JSA and six months on part-time minimum wage. :rotfl: Also kept scheduling random appointments but not telling me, have you had that?

    I just blind them with medical terminology and invoke the power of Disability woman, they don't mess with her clients. :rotfl: What did they mess up? You should really be coasting along with no change, as you are presumably on means tested?

    I have been refusing to take inhalers for 2 years now and my "asthma" nurse told me 3 months ago that i would be house-bound in 4 years if i did not take them !!!!!! to s s pot of a woman... i dunno - give nurses doctors' jobs and they go all dictatorial on you !! (apologies to excellent nurses - rant over )

    I did not know what an amazing overal difference acupuncture would have on my body till i had it.. my legs feel half the weight they really are; my energy is SO much greater; my breathing is better; i sleep better... i feel more energetic and motivated... if you have some funds.. give it a go.

    My therapist does a great thing.. she gives you a private initial consultation and takes a history then gives you treatment.

    Next visit you share the treatment room with A N Other - 2 couches.. lovely music.... 2 nice big screens for privacy. and as you sit silently for over half an hour alone with needles hither and thither she is treating the person in the next bed.... half the price.....

    have either of you had a total stranger look at your CV ? sometimes a new pair of eyes can see things you just dont see .. and i dont mean the "Paulines" at the Job centres...
