Parking ticket for parking ticket for parking in disabled bay, urgent replies please

Hi my husband parked on the retail park at Robin Park Wigan yesterday and parked in a disabled bay. He forgot to display the badge in the window. The badge belongs to my daughter and she was with him at the time (any cctv footage at the retail park will prove this). The car is also a motability car and has a tax disc that shows it is motability.
He has received a fine from the parking company CMS UK limited for £50, rising to £80 if not paid within 14 days. (He was parked up for 10 minutes). Apparantly, we can appeal but have been told that it is a waste of time because they wont cancel it.
Someone has told us to ignore the parking charge because they are a private company. I dont know whether to risk ignoring it or not. I am worried about them putting the charge up or even taking us to court.
Has anyone ever risked not paying this company?

Take a look around. A private company cannot fine you and this ticket cannot be enforced.
They may well write to you a few times, but you just ignore them and they'll go away.0 -
Have a root around the forum and you will see the accepted advice is to ignore tickets issued by private parking companies.
I have successfully ignored two, but you should prepare yourself to receive a stream of threatening letters, which will stop eventually.
Some people even get phone calls, although I did not.
The appeals process has been proved to be a sham time and time again.
The companies seem to use it to gather evidence, in the course of the appeal you will almost certainly admit who the driver was.
Ignore all correspondence, and do not contact the company in any way.0 -
Appeal... Provide evidence with the letter of appeal and it should be cancelled.
Once I got a parking ticket I forgot to display the ticket I already had, so I appealed and provided copy of the ticket and I was let off.0 -

Thanks. I think we will risk it and ignore then. What would happen if I did contact them just to explain that we did have a badge and that my daughter was present and then ignored any correspondence from them?0

That may be so with a local authority issue ticket, but the evidence suggests the private companies do not operate in that way.
Bear in mind this disabled bay is on private land and therefore cannot be part of the blue badge scheme.0 -

I did that recently, but it was a local authority car park, and they do have the power to enforce parking tickets.
This is a private parking company (PPC) so the best advice is to ignore it. They will go away eventually, but you need to be determined not to be bullied.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

They would probably take it as a 'bite' and put your file on the 'try harder to intimidate' pile.0 -
Ive just had a thought though, seeing as the car is a motability car, if they contact dvla to find out who the registered keeper is, will this go via motability, and will they get involved in forcing me to pay?0

No, Motability is merely your finance company.
The DVLA will disclose the name and address of the registered keeper, which I take to be you or a member of your family.0
