Advice on dla

I just wanted to know if you send a written statement letter to DLA from your specialist, plus statements of people who know you, will this be enough? I have also given them specialist details but just wanted to know if they prefer to contact them themselves or have you send the info?

Don't rely on them to contact people for you.

unless it (the statements)specifies your care and mobility need then there isnt realy any point to sending them.

diagnosis is NOT what get you DLA but what the condition brings as in care and mobility needs.

if they believe you have a case the will:

write to you GP. (do they know your care and mobility needs?)

write to your specialist. (do they know your care and mobility needs?)

write to your consultant.(do they know your care and mobility needs?)

seek guidance from a medical assistant. (a medically train person who has never seen you).

ask ATOS to assess you at home.(when the time comes have a witness there with you to write down Q and A's as they were asked and winess any physical tests).

I already get DLA at lower rate for both, have done for years, they sent me a form [only a page long] regarding the new rules in April 2011. So I sent it back with 2 statements of people who know me and a letter from my specialist.

I think it's best to have it there all in front of the person who makes the decision so it doesn't delay it any longer.

I generally think the more information you send the better but do be prepared for the DWP to still write to your GP/specialists. As already said, it's not the diagnosis which counts but the care/mobility needs. The form they send to specialists also has a section on what your prognosis is - are you likely to improve/get worse and over what time scale.

I have just had a read of the notes attached to the DLA1 and the DLA1 itself, and there is no instuction to send in any evidence at all!

Doesn't mean you still can't send any in. Actually, I'm sure there was something about if you have a care plan, tick the box and send it in.

I've read a lot on here and other places that the more info you send the better? who knows but worth a try.

Generally, yes. I found that when I just wrote something on my form and explained, they disagreed that I needed help. When I updated them with changes, I sent them in 2 pieces of paper from SS (not a care plan) which stated the same thing. They then decided that I did need help.

Yes on page 8 (section 19) the form asks if you have any reports including a care plan. It asks if you would send a copy in, but also adds a rider to not worry if you don't or won't send it in.
And that on page 38, it asks you to list what you are sending in with the form.

Finally the form says that it isn't important if you don't send anything in as the DWP will take up references anyhow if they think they are appropriate.

So it seems that you have the choice if you want to send anything in with the form but it clearly says also that it is not necessary.
The inference is that the decision is made based on the DLA1 and any reports that the DWP ask for.
You are under no obligation to do the work for them!

This isn't a new claim it's regarding the rule change in April they sent me a form, just a page or so to sign and send back. so I got a letter from my specialist and put that in also with 2 statements.
