LLOYDS TSB - Should I try and Claim?

Hello all,

I have an overdarft circa £4500. I have been absolutely hammered by bank charges over the years in the time my wide could not work. Should I bother to pursue a claim - will they close my account of I try?

    They wont close your account.

    However, what reason would you have to request they refund some of your charges?

    I'm afraid you've rather missed the boat on charges. After the outcome of the Supreme Court case any arguments based on proportion, unfairness etc aren't really going to work either with the banks themselves or FOS.

    If you are currently suffering from hardship caused or exacerbated by charges which you are still incurring, then go for it. But even then the banks don't have to refund anything. All they are required to do is treat customers experiencing financial hardship "positively and sympathetically". This is a wide definition which could include a number of things.

    If the above doesn't apply to you, then don't get too excited about seeing that £4,500 again.

    Charges claims these days are more a matter of hope than expectation.

    Have you been "hammered" with overdraft interest and charges for rejecting DD's, cheques etc and maybe charges for exceeding your overdraft limit? If so, are these charges in line with the terms and conditions you accepted when you opened the account and set up the overdraft limit? If so then there is no reason for you to ask for the charges to be waived or reduced. This mot being hammered.

    On the other hand if they have applied charges that really are not in the terms and conditioms then yes you should contact them.

    Hi,i am currently with lloyds tsb and have been since 2008 i've been getting bank charges for direct debits since then....i have canceled all my direct debits but im still getting bank charges and overdraft usage fees,unplanned o/d fees and o/d interest,i really dont understand why they keep taking this money from me,also i've recently been informed from somebody from jobseekers deparment that under the social security act 1992 or something like that anyway that the banks cannot take benefit monies from my account. I would be very grateful if u could help me with this matter as it is causing me lots of worries and stress im a single mother to 3 children who always seem to need new clothes/shoes,school trips and many other things brought for them. thankyou

    Talk to your bank if you do not understand the reason(s) the bank are charging you.

    Until you understand the reason(s) for the charges, you cannot hope to avoid them.

    Go to your local CAB and get some better advice. The old chestnut that banks can't apply charges to income from benefits got exposed a long time ago. Banks neither know nor care where your income is from, and aren't obliged to check either. They will simply use any money paid into your account to address charges where they fall due. CAB, CCCS or National Debtline can give you advice if you're in hardship, and the DFW boards can assist in adivisng you on setting up a new account for your benefits to go into if you're continuing to incur charges on your account.
