my father passed away earlier this month i am just sorting his bank account out, i am the only benificary and his bank said if the amount is under 25k then it does not have to go to probate but unfortunatley it is £4.95 over that, i really dont want to go to probate unless i have no option. £21k of that money was in a saver account in joint names with me, will the bank take that into account also i have had expenses in having to get 2 letters wittnessed by a solicitor which cost £10 . any advice would be great

The £21k in the joint account should go straight to you. Won't the bank amend the account details to show you as the sole holder on production of a Death Certificate? That would reduce the amount to way below the probate requirement.0

Hi Stuart...you can also draw money from the account for funeral costs without it going to probate. The cheque will be issued to the undertakers direct on receipt of an invoice. You will need to fill in and sign a declaration. In the case of Nationwide Building Society, 4 pages long.0
