Joint Mortgage with an ex

My Fiance owns a house with his ex wife although she was only there for 3 months and then left. She doesn't work and therefore my ex has always paid everything into the house including the mortage.

They are divorced and it is written in because he's paid everything into the house she gets nothing of the profit. Unfortunately to remove her name he does not have enough borrowing power. Currently I am not in position to replace to her on the mortgage.

So the question is - can I move in to the house whilst she legally is joint owner? Does she have any legal right to remove me from the property?

  • He could speak to the bank and explain that he has always paid the mortgage, show them the divorce papers. You never know what they might say.

    As above, it would be worth talking to them and showing them that he has been paying the mortgage alone all this time.

    I don't know whether she can stop you moving in - I doubt it because the other owner is allowing it.

    What would concern me more is that, as an owner, she has the right to come into the house whenever she wants. Do you want her looking through all your stuff?
  • I would arrange for her name to be removed from the house deeds (you'll need her consent). Her name will stay on the mortgage, but she won't own the house, she will be like a guarantor in case your boyfriend misses a payment. That is what I did with my ex husband. Speak to a solicitor, it can be done.
