I put a deposit on a car- now they are advertising it

Hi all
I put a deposit ona car last weekend- the car was not ready to drive away that day as it needed some cosmetic work at the front- the garage already had a person coming out on tuesday for this. It also needed some work done on the bearing on the clutch. So I paid the deposit, arranged to part ex my car and I told them that I would come up next week to collect it (tomorrow) - because of the work on the clutch I made them write on the paperwork 'subject to test drive'.
I came home on Saturday and was looking at autotrader and the avdert was pulled off the site about 2 hours later.

Last night- the car appeared back on autotrader with £100 more on the price tag. I though the deposit and paperwork meant the car was secured to us. Now I feel worried that
1. they have decided, having done the clutch and body work that the car is worth more than the price I have written on my invoice
2. that they are going to sell it to any tom, !!!!!! or harry that could come in today and pay the entire amount?

does anyone have any idea where I stand? I am expecting the garage to call me today

    Maybe they are covering their side of things if you exercise your right to pull out of the deal after taking your test drive.

    As far as the garage is concerned the deposit you have paid doesn't bind you to buying the car because of the condition you attached.

    So they are entitled to still look out for other customers.

    Normally deposits are binding on both parties, but in this instance, yours isn't.

    Also, when a buyer turns up for that car, they can try to sell them something else instead - i've had this tried on me a few times.
    Nothing I say represents any past, present or future employer.
  • panic over- just spoke to them- it turns out that the clutch problem is a much bigger problem than they thought- they have already refunded me the deposit so they are selling it and informing people of the problem- as a garage they are not going to carry out the repair.
    so at least I am all sorted out! PHEW!

    Makes sense to me.

    They've bumped the price up so that when they inevitably end up having to drop the price to take account of the clutch problem, they end up making more profit.
