Advise needed re EDF / Warrent
Hi all
Ok, so tenant left a property, i went in collected post. One was addressed to owner of property. I opened it as authorised to deal with everything in her name.
It a letter from EDF saying a warrent has been served to cut off the supply due to none payment. I contacted with details of when tenanted etc as owner never lived there, been tenanted or empty. I asked them to send correct bill to landlord for void periods.
They wont do anything without a copy of the previous tenant's tenancy agreement. I have said under data protection, I cant give them this but i will ask previous tenant if he will give permission.
Anyway, new tenant moving in tomorrow but they wont start an account in her name and say they will go ahead and cut off the supply anyway.
I have quoted section 16 of the electricity act 1989 to them but they says its not relevant as the property has a debt.
Any ideas what I should do next?

With regards to the disconnection, the incoming tenants agreement should be sufficient to stop this.
However to get the accounts out of the landlords name, the tenancy agreement will have to be provided.
You are allowed to give tenants details to utility companies...

The tenanacy agreement itself doesn't contain personal information about the tenants, it provides information on the terms and conditions of letting the property so it wouldn't be covered under the DPA.
Many suppliers request copies of tenancy agreements to prove liability on a regular basis, it is likely if this was actually illegal the regulator or information commisioner would have taken an interest by now.0
