On 26 January 2011 a PCN with the number xxxxxxxxxxx was issued by your Civil Enforcement Officer No: GEEK. The vehicle, a CAR (obviously) with the registration TOP MODEL, was at the time it was observed (afternoon the day the above) parked on (NO CONSEQUENCE). A ticket with the number WOW for £ TOO MUCH had been purchased from the P & D facility at WHEN WE BOUGHT IThrs and expired at WHEN IT EXPIRED, at which time we had long left the car park. When my son displayed the ticket correctly and face up on the dash board and we closed the doors of the vehicle, we both were satisfied that the ticket was clearly visible. During the time we spent in TOWN we returned to the vehicle on two occasions to load some items we had purchased into it. So at least one door and at one stage two doors had been opened and closed on these occasions. We believe that is was due to the turbulence created in the interior of the vehicle, that the ticket had been moved and landed on its front side. Due to this circumstance, of which we were not aware the PCN was issued and the reason given is: 'Code 83 Parked in a car park without clearly displaying a valid pay and display ticket or voucher or parking clock'.
The following day I have contacted your department in order of explaining what had happened and offering to provide proof of a valid ticket. Sadly, to no avail. In fact I was actually told by one gentleman, who I believe works together with a Mr I WON'T SAY RUDE WORDS, that tickets being moved by turbulence and landing the wrong way round or anywhere else in a vehicle other than where they were originally displayed, is unheard of. This information I was given, is actually incorrect. There is a PDF document available on the internet that is specifically about this phenomenon and it is called 'The Joint Report of the Parking Adjudicators for England and Wales 2006'. I trust you have heard or even read this document, as it deals with your line of work. I was told that you have photographic evidence of the exact location of the ticket and I would like to view this evidence, or preferably even have a copy sent.
As my son and I strongly believe that the issue of the PCN is unjust on grounds of various circumstances and that an appeal against the fine is more than valid, I would now like to ask you to supply me with the contact details of the Adjucdication Service and of the Local Goverment Ombudsman on the earliest possible occasion, but due to the dead line for an appeal, please not later than coming Tuesday.
I have already requested the TRO of this particular car park facility to be emailed to me in form of a PDF File and this should be send to me on coming Monday, by a lady called WHATEVER from your Legal Department.
Thank you in advance for your assistance by providing me with the contact details of the two officials I will need to contact to launch an appeal.

If its any help, I have noticed that the air vents which defrost the windscreen are largely to blame. I often use the heater position which recycles the air in the car. When my wife changed it to use air from outside the vents allowed air to circulate even when the engine is switched off. Worth considering.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Thank you for pointing that out. It all comes in handy and actually is further prove of the fact that certain tickets are unfit for their purpose and make it next to impossible to comply with their demands.0 -
Here are some pictures I helped myself to from the council's piccy facility:
The culprit ticket photographed after having flipped over. I can't make out, however exactly where on the dashboard it landed after it had become airborne.
The Car Park Sign. Maximum stay is three hours and three hours according to the sign will cost 170 p. Our ticket, however, says it cost £2.20. Is the sign out of date? Also, the seriel no of the ticket is clearly visible. Isn't that prove that the ticket was valid?
A copy of the PCN. It said on one on the payment slip to 'use the envelope provided' to pay. We weren't provided with one.

Last time this happened to me I just sent them a scan of the flipped ticket and they cancelled the penalty.0

-I've looked at the photographic evidence on their site (posted the relevant pics above)
- I've sent them an email challenging the fine (copy above)
- I've studied the TRO's they sent me thoroughly and forwarded them to pepipoo. Result: No offence has occured
Sadly, I didn't hear anything of their parking department yet. So some time today or tomorrow I will send them another email. The fact that the parking department seems to deliberately ignore my emails only leads me to believe, that they've themselves seeked for advice in there and mistake me for a PPC?In anyway...if they think for just one second that I will eventually give up, just pay and get out of their hair for the sake of saving my nerves...then they have entered the wrong cruise ship (if you know what I mean by that). That won't happen and not even if Hell freezes over. Them igonoring my emails can only work in my favour, so I believe anyway.
