Help in deciphering JSA appeal notes pls

Hi all

My partner and i are currently appealing against an JSA decision, and we have been sent notes from the jobcentre database. Some of it though is in shorthand and we wondered if anyone who works at the job centre could helps us decipher it here it is:

Any help would be much appreciated as since we started an appeal due them providing us with incorrect information, the have put in an appeal against us saying that we havnt repayed an over payment from february last year, when infact we have.

They also say they have lost the paperwork saying that they notified us of an over payment, but i have found this in our appeal notes that were sent to us by them.

Hope that makes some sort of sense. Thanks for reading :)

    What incorrect information did they give you?

    My partner was offered a part time job of about 8 hours a week, before he accepted the job he went to the job centre and spoke to a a member of staff if this would affect his claim or JSA payments in any way. He was told no, that because he would be working less than 16 hours a week it wouldnt effect his claim in anyway and he would still get paid his normal JSA payment amount. So he started work and was getting wages for his 8 hours and JSA payments.

    The following week he went in to sign on as normal and was asked why he hadn't filled out any timesheets for his employment, he told them he was never given any and so checked his file and found the timesheets in there. They didn't know why that hadn't been given to him earlier. He was then told to fill out the forms and put that he worked 15 hrs and 59 minutes so that he was under the 16hr rule. He did this and took the forms back the following week. He was told by the same person he saw the week before that he can't put 15hrs and 59 mins as they would say no and send the forms back. So he was given a new set of forms and told to fill them out correctly, which he did and brought them back the following week.

    About 2 weeks later they told him he shouldn't have been recieveing JSA payments after all and so we would have to repay the overpayment of £436.80. A week later he was let go at his job as the company wasn't making enough money to keep him on. So to repay this overpayment the Jobcentre wouldn't pay JSA for another month. We had to live off just CTC and CB for a whole month. Had we known that we weren't supposed to get JSA while he was working we would have kept the JSA he was paid and not spent it, so that we could give it straight back.

    This is why we appealed

    The letters you see at the end of a note are the initials of the person(s) who input that note on your records.
  • If you were advised incorrectly then you should definitely ask the Jobcentre to look into it. However, can I just query what you have written in your post: ' He was then told to fill out the forms and put that he worked 15 hrs and 59 minutes so that he was under the 16hr rule'. This statement would infer that your OH only put these hours so as to be under the 16 where his claim would be stopped and in fact did work 16 hours or more? What hours did he ACTUALLY work?
  • You state in the original post the job was for 8 hrs per week not 15h59mins?
  • Sorry i wasn't very clear, i wrote the post in a bit of a hurry. The job was contracted as 8hrs, but he also filled in when people called in sick. So some times he would work 8 hrs or sometimes 12 and i think once or twice it was exactly 16hrs. He was told that if he put 16 he would be cut off, but as it was rare he was asked to do 16hrs they said he should put 15hrs and 59 minutes on those occasions.

    Something else i just thought( sorry as you can see from the above post this all happened nearly a year ago so isnt very fresh in my mind) he was later told that because it was a family claim for JSA i.e he claimed for me (his partner) and because we have 2 children both under 3 at the time, that he could actually work upto 22hrs without it affecting things. But to be honest we were told so many different things by so many different people i don't know what is right or wrong.
