my other half challenges a pcn and say he has lost

and he has also lost his right to get 50% off the rate initially given if paid within a certain amount of time. is this normal? also he got the fine but in my name...and he does not have much money at mo. would i otherwise be responsible if he used my car?

  • First you must say if its a council ticket and give more info if it is.

says was done by cctv . person who wrote it up it says is an authorised officer of croydon council. does that help? it does not say it was rejected by a judge but by a debt recovery and adjudication officer.

Council ticket so the registered keeper is responsible, unless he used your car without your consent (perfectly possible even with an OH). Not being funny, it's a valid appeal point for you if you were not aware/agreeing that he could use your car! It's a specific appeal point listed on the PCN letter.

Second point is, if you have got past the reduced fine stage then you have absolutely NOTHING TO LOSE by continuing with the next stage of the appeal, to the adjudicator/PATAS. It hasn't got that far yet has it, it hasn't already gone to an adjudication hearing and had a decision?

You must keep within appeal deadlines so read the letters carefully - and it's up to you as the keeper to respond. The odds are in your favour - you could win your case (most adjudications are found in favour of the motorist or are not defended by the Council).

No point just paying it without at least seeing whether pepipoo forums can find any more avenues of appeal for you for PATAS. Some Croydon bays and Traffic Orders were questionable (possibly not compliant) I remember, when I saw a Croydon post on there last year...can't recall the details.

Post a new thread/topic on pepipoo here (link below) after registering first - but ONLY post if you attach pics of all pages of all letters and the PCN letter for them to pore over:

    http://forums.pepipoo.com/index.php?showforum=30

Follow their guidelines on 'how to post pictures' and blank out the PCN number and reg number, plus cover your name & address. Leave in all the dates, location, times, small print in your pics as they are important.

Oh, and please give pepipoo more detail in your first post there, than you have given us here, not enough to go on! Tell them where it was, show a Google Street view link to the place if you have no pics of the lines & signs to include with your paperwork pics. Tell them what your OH appealed on, show them all the replies.

HTH, no point coughing up without trying further appeal, if the discount has gone.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
