Paypal Dispute Help needed

Hi i was trying to serch the forum with no luck so wonder if someone can help.

I sold an item that was full working when it left me and also ( I know I know ) left positive feedback first.

After a discution with the buyer it turns out now the person has started a dispute through paypal along the lines of the item was not a described.

I had allready offered a refund on the item so no probs there, the thing is acording to the bit i read on paypal they`ll refund the money to the buyer when they have proved the postage of the item back to me.

So

1 Does this mean there not going to ask me if i`ve recived it first ?

2 What if he has broken the item and it`s no good for resale where do i stand then ??

Also because i left positive feedback and he hasn`t left me none can i get mine removed due to the transaction now not taking place ?? :confused:

    1) Paypal will require the buyer to return the item using a tracked method, only then will funds be released to the buyer.

    2) There are scammers out there who will swap an item bought with a broken item, but this is often detectable by a careful read of their feedback. Look to see if any seller has left any negs, or even positives with a warning, a coded positive might be 'item returned broken for a full refund' type of thing so that other sellers can see if a pattern develops. Unfortuinately though it is difficult to do anything about a scam like that.

    3) Your feedback cannot be removed under any circumstances regardless of what feedback the buyer leaves you.

    Normally for items broken in transit, or whatever, a seller will ask the buyer to return and promise a refund should the item be returned in the same state that it was sent. With damaged items paypal do not automaitcally find for the buyer so there is often a bit of leeway for negotiation.If on return it seems that the item may have been damaged in the post, then assuming you have a certificate of posting you could start a claim against the RM for damage, but in that case you would need to original packaging.

    An update :

    I`ve now read what the buyer used in his dispute sent to paypal (phone not working etc), which is totally wrong i actually think he may have damaged it on purpose now.

    Also to start the claim he recons that ive sent long and abusive emails and refusing to refund the money.

    I didn`t read this till after i clicked on refund. I feel it`s a complete defomation of character as i have 100% feedback with 80 odd stars so all the others can`t be wrong.

    I`ve actually spoken to paypal on the phone this morning and the resolution centre say i have to send a complaint to them somewhere.
    I stated what the buyer has put is totally wrong about my self and my reputation. and he has just put this so as he stood more chance of getting his money refunded.
    Should i just let it go ?, but what happens if he has broken the phone i`m then left out of pocket and no phone to resell.

    When you have a buyer like this you do not arrgue with them, because if the item was not broken it sure as hell will be by the time it gets back to you.

    Any dispute like this should be handled to ensure you get the item back as quickly as possible. You must take a note of all serial/IMEI numbers etc. Never get into an argument online. Retrieve item and then decide how to handle the problem.

    The last buyer I had a fight with ended up immersing an electrical item in water and was threatening me with court action. I of course had sent it back to the manufacturer to confirm the damage was not accidental.
  • Yes i understand theres no point losing you rag (even tough sometimes we wish we could) but i have all the transcripts between ourselves, yet he is portraying a different scenario alltogether so that paypal will take his word more than mine.

    Also i know 100% the phone works because it was my own and i only sold it due to an upgrade so i do know the history of it.
