dla appeal

can anyone tell me is it worth apealing when your application has been turned down in this present climate when the government seem hell bent on making these cuts.

    If you truly believe you should get it, yes. Mine was turned down initially solely because they said I could make a meal if I sat on a chair as I couldn't stand long enough. However when I appealed I pointed out I couldn't actually lift the chair to move it to where the meal was being made somebody with some common sense reviewed it.

    Appeals are literally becoming a part of the claim process these days, they are that common.

    My son's was turned down, despite having reports from his GP and CPN. We went for a reconsideration. You can go over the reasons why you disagree for their decision over the phone. They reconsidered, and we were turned down again. So we applied to appeal. In November he got a letter saying that they'd had our request to appeal, and then for no reason 6 weeks later we got another letter saying they'd looked at it again, and he got awarded middle rate care, and he wouldn't have to go to appeal. The decision was overturned just before Christmas. He got money backdated from July when we first sent off the claim (after being told to claim by his GP) He's been awarded until July 2012.

    I represented a guy yesterday at an appeal, he is 56 can hardly walk uses a stick, has angina, deaf in one ear, panic attacks, shakes all the time and the worst stutter that came on a year ago that anyone can imagine, he is virtually housebiound and his wife has to attend to all his personal needs and he was refused dla!!!

    The current political climate doesn't affect DLA appeals. The tribunals are independent of policy makers. Provided you consider you are eligible for DLA based on the criteria, you should appeal.
