Seller Issue, probably a common query...

Bought some personal headphones for my ipod, seller sent on 31st October sent by Royal Mail recorded delivery. Check the tracking number on Royal Mail site & comes up with this response...
COME BACK LATER - Recorded Signed For™ items are only tracked after the item has been delivered. Depending on whether the item was sent first or second class, this may be a few days after posting. Please try again later.

Information on your item is not yet available online.

Now whose responsiblity should it to be chase this? I'm on the understanding it should be the seller, as thats who my contract is with (i paid them for the item and they arranged the delivery).

Anyone had any experience with anything similar & can offer some constructive advice?

  • You're right that it is the seller's responsibility (regardless of any disclaimers to the contrary) to ensure your item reaches you safely. If an item is lost in the post, it is the sender not the intended recipient who should claim from Royal Mail.
    Recorded delivery does not guarantee a faster service though, so it could be merely delayed. Recorded is treated as standard mail when it comes to delivery times, so Royal Mail will not entertain compensation claims until 15 working days (normally 3 weeks) after posting. Some sellers will refund a little earlier when goods go astray, but others will wait until the item is officially lost in the post.

    Keep in contact with your seller, as contains mind peril suggests recorded is not a next day service and sometimes it can be delayed. You might want to contact your local sorting office though just to see if they have the parcel and have overlooked leaving you a card for it.

    Ultimately though it is up to the seller to get the item to you and they will be responsible for repaying you regardless of their own claim against the RM. Personally I would be loooking for a full refund in week 2 from my seller, possibly in week 3 if the seller has a continual turn over of sales which means a steady through put of paypal funds.

    I'm assuming you paid by paypal, so whatever happens you can start a chargeback as early as day 7 and whilst your recorded delivery reference shows no delivery, you will win.

    A good seller though will be looking to repay you with the minimum of fuss and won't want this to go to a chargeback.

    Thanks guys, yeah im not to worried about a refund, i genuinely want the item & im sure it wouldnt be much for him to send out a replacement!

    I'll wait till the 15 working days are up & then go through the process then! :)

    Watch your time limits carefully!!

    The seller can't claim against the RM until 15 working days have passed..ie 3 weeks. Their refund may take another 3 weeks to reach them (I'm still waiting for one over 3 weeks ago) by which time you are out of time for a paypal claim.

    Your chargeback must be logged with paypal within 45 days of payment, there is no extension to that deadline at all.

    As a buyer the one thing you should do is go to the sorting office and see what they are saying. Take the tracking number with you if you have that.

    Yeah thanks for the heads up on the paypal bit. Ultimately like i said, i wouldnt be after the refund as i genuinely want the product i was purchasing, should be too much hassle for the seller to send out another one for me? :confused:

    If you lose the opportunity to do a paypal chargeback then you have nothing as leverage to get a replacement.

    By all means wait for the seller to send a replacement, but if he doesn't and assuming of course item fails to arrive, then make sure you start the chargeback within 45 days.
