I paid for temp membership with Club La Costa with my Credit card. I have since decided that I had been lied to by the salesperson. There terms and conditions state that I have 14 days to cancel which I am well within. If i follow their proceedure and they don't refund me are the credit card company liable under Section 75?

How much was it for?
Section 75 is for > £100.
If you hand in your cancellation letter then get a receipt.
If the person says they can't give you one, then write your own on a piece of paper and get them to sign their name ("I have received a cancellation letter from Mr X on day N month M").
There is a certain gym that denies getting any cancellation letters.
If you send it in the post then I would advise recorded delivery for an extra 74p or at the minimum a free proof of posting.
The different is that recorded delivery "proves" it's delivered whereas the proof of posting proves it was posted.
Legally posting is enough, but you could potentially have more arguments about it.
I don't see why they won't pay if you have cooling off period but you need to make sure your cancellation isn't "lost".0 -
It was for £4k and I send letter by special delivery so I can track it and know exactly when and who recieved it(I hope).0

Yes, it's worth spending £5 here to make sure it gets there on time and you know it was delivered.0
