DWP Letter

Sister was involved in a car accident on the 29th December and was in receipt of Income Support.

She is claiming for whiplash ( which she truly has )

Today she received a letter from the DWP Compensation RecveryUnit.

The letter states:

"Why we are writing to you

You have made a claim for compensation, therefore the person or organistaion that you have claimed against (the compensator) has registered the claim with the Compensation Recovery Unit ( CRU ) which is part of the DWP. The CRU is responsible for identifying and recovering any social security benefits/lump sums that may have been paid to you as a consequence of the accident or injury you received on the 29th December 2010

The CRU will tell the compensator the amountof benefit/lump sum, if any, they have to pay back to the CRU if you are awarded compensation. The information is shown on a certificate, which is sent to the compensator, please find enclosed a copy of thatinformation There was nothing included with the letter

If compensation and benefits are paid to you to meet the same need, the compensator may reduce your compensation award to take account of the amunt that has to be paid back to the CRU.

If you disagree with the certificate ........ It then continues with the normal adjudication and review process and how to go about it.


Personally I cannot see where they can claim money back? She did not get a sicknote and claim any other benefits and continued her Income Support. Her neck muscles have been strained (cannot remember what the independant doctor called it ) she had difficulty picking up her disabled son and other discomforts like headaches and settling to sleep


Can they claim anything back from her? She wont if anything get ore than about 1.5k so will still be under any savings allowance.

  • if she has claimed/wont claim any new or additional benefits because of her accident then she wont have to re-pay anything,if for example she had claimed esa after the accident BECAUSE of the accident then she would be billed for those benefits which would normally be added to the claim anyway

    Thanks woodbine. She claimed nothing in relation to this accident and was only in receipt of her usual Income Support.

    Bear in mind that as Income Support is means tested if she does receive compensation the level of income support she receives is reduced if capital rises above £6k and at 16k payments would cease until capital had fallen below this point.
