in Credit cards
Santander have been overcharging me for over 2 and a half years now on my credit card. I complained to the Financial Ombudsman and the Adjuciator upheld my case, they didn't accept, so I went higher to the Ombudsman and they agreed in my favour :j
My question is:
Does the money they owe me HAVE to go back onto my credit card balance or can they pay it to me direct?
The way I see it, is the Financial Ombudsman upheld it and Santander are supposed to put me back into the same financial position I would have been in 'if' I had not been paying their extortionately 'high' interest rate.
Can anyone advise, because I could really do with the money being paid diectly to me and not Santander.
The whole case has been a nightmare and the managers of Santander have been refusing to call me back.
Thanks in advance.

Think about the interest you will save if the card debt is adjusted.0

That's it! Charge and refund cancel each other out.
If after the refund your account is in credit, then it is your money. If you are still in debt to the card,
it will be credited to your account, paying parts of your debt.0 -
why would they...0

What is frustrating is... they've been charging me over double the amount of interest they should of, and I have had to wait for over 2 1/2 years knowing that I have been paying them this additional amount of interest each and every month, until the Financial Ombudsman could review my case.
Which means I could have used that money for other purposes in the last 2 1/2 years. Hence why I feel it is very unfair if they pay the money directly off my credit card balance when I should be given the choice.
Does anyone know whether I am within my rights to ask them to pay me direct or know if anyone has gone through something similar?
Thanks.0
