DVLA and vehicle transfer process

Hi,

I am helping a friend who has received a fine from the DVLA for failing to declare a vehicle SORN. The vehicle was transferred to her without her knowledge let alone consent.

I understand the process for a vehicle transfer is for both the old and new keeper of the vehicle to complete certain parts of the V5C form and both parties to sign?

I am not aware of all the details yet but are there any safeguards in place to ensure this is not done fraudulently? Presumably it is up to the DVLA to prove that a vehicle has been transferred legitimately?

  • Usually DVLA check to see if the original owner of the vehicle complains within 14 days of the vehicle being transferred without permission and action that i dont think they check the new owner of the vehice and whether it was transferred fraudulently to them.

    Did she notify them that she had received registration papers for a vehicle she had no knowledge of?

    This is one thing i would pull my finger out to sort, You dont want the car to be used illegally and have
    people knocking on the door. Or even knocking it down......

    how can it be without her knowledge? Surely she received the log book in her name and adress for the vehicle.

    I guess this is pretty much what I am after, what happens once the DVLA receive the V5C?

    Checking into it further and now having some documents/letters this happened 18 months ago, the car is owned by an ex-boyfriend. After the transfer she received the updated registration certificate and contacted the DVLA who suggested writing a letter explaining the situation, including the updated certificate.

    I believe at the same time she completed an SORN form under advice of the DVLA. This doesn't make much sense to me as she could not make a declaration for a car she had no knowledge of. This fine is now for the following year.

    I am planning on phoning the DVLA but would appreciate any additional advice on how to proceed in any case as I have no personal experience of the process.
