    You have already been given the answer there is no rules set purposely and each case is looked on its own merits. They are best getting it in writing from the DM.

    I think she will read this and understand but i believe her worry will be if she asks DM what point, when as, did we become a couple as to avoid her having to back pay any benefits awarded.Thus if they cant state a time current but later state a time in the past that as far as they are concerned she became a couple months prior, whos doing would it be at fault if they asked for hundreds of punds back.
    Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

    Dont quote me on benefits law, but in tax (Domicility) rules, Property law defining ther expression of "co-habiting" persons and estate and succession planning and trusts law, the yardstick is 90 nights in a 12 month period starting from at the beginning of the financial year.

    The OP cannot afford to pay for the roof over her head. She also has no "partner/husband" to help her support the child she looks after.

    The state are happy to step in and take care of the above but only assuming her circumstances are correct.

  • I had this problem before my partner moved in. I kept getting visits because busy bodies would claim he was living here when he wasn't. So I asked one of these officials who told me that it doesn't matter as long as I told them when/if he moved in. I was really wary of taking that seriously as I'd had so many different replies to that question before..

    I find that depending on who you ask, depends on what answer you get. There seems to be new/different answers everytime. :/

    girlpantssx, you seem to talk plain English, seems a lot on this forum are self riteous in their officail interview type talk.ahem. is there any folk left that can just say just give me a straight answer, never mind thsi wind and pish im married to are am a dss officer talk and evryone is below me in rank, you the unemployed.
    Maybe us Scots dont mince with our words.

    Well this Scot doesn't mince their words. There isn't a straight answer, it's not a simple oh he/she can stay 3 nights per week or everyone would be bloody single just to reap all the single benefits.

    With council tax I was told it was 90 days a year.
    There is no set figure in council tax legislation. If you are resident for as little as 1 day then you can be regarded as resident for council tax purposes (depending on the situation) for that period.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
