Capital one closed my account but still on credit file?

It's been over 3 months now and they refuse to remove it and state the details on my credit report to be correct (That I still have a card with them just not using it.) After they sent me a letter saying they are closing the account with immediate effect and to destroy the card. What can I do?

What was the date on the letter stating you should destroy the card?

Is the account closed and settled with a NIL balance or is there still a balance left that you are clearing as per the original terms?

Nil balance, it was in September 2010

Something like this:

To Whom It May Concern:

I am writing to you today with regard to a credit card account I used to hold with you. You advised me over four months ago that the account had been closed, and as we both know, it is settled with a NIL balance.

I am therefore very concerned to note that according to Experian, Equifax, and Call Credit, the account is still open with the full credit limit available to use.

As this suggests to 3rd party creditors that I have access to a line of credit, that in fact I don't, I find that the data is not only inaccurate, but also potentially defamatory.

I therefore provide 14 days from the date on which this letter is signed for for you to manually update all three credit reference agencies with the correct information save my referring this matter to the ICO.

Kindly advise by return once my lawful request has been actioned.
