Divorce petition...... Please help!

I have been to see a solicitor about divorcing my husband. I am paying for everything. I paid the £340 for the divorce petition and it was sent to my husband to sign. He signed it but instead of sending it back to the court he gave it back to me . I told my solicitor that I would send it but I clean forgot about it! The petition was dated 6th October 2010 so what I am wanting to know is can I send it back to the court now and will it still be valid. I can't really afford another £340 and he certainly won't pay.

I dont know if these things have a timeline to them. Phone your original solicitor and ask them tomorrow morning. The solicitor is a bit slack, shouldn't he/she have chased you up for it? Unless its just been assumed that you have changed your minds.0

No, there's no time limit, although the court say he should return it within 7 days of receipt of the petition. The 7 days just refers to the time after which you can apply to the court to progress the matter without him having returned the acknowledgement of service. Just send it to the court. When the court receive it they will send it to you and then you can apply for your Decree Nisi.Proud Mummy to Leila aged 1 whole year:j0

I was trying to avoid a phone call to the solicitor because its really expensive and my husband Isn't giving me a penny towards it. I think I might go to the court in person and see if they can help.0

Thank you so much. I was panicking in case I had to fork out another £340.0 -

If you ring the court and speak to the clerk to the divorce courts they are really helpful, and many of the forms you can download yourself from the web.Free/impartial debt advice: Consumer Credit Counselling Service (CCCS) | National Debtline | Find your local CAB0 -
