Paypal Dispute Advice Needed

Sorry if this all all been covered before, done a search but cant find the answers I was looking for
I bought a new car part from a seller on ebay with 400+ good feedback for £45, via paypal, it turned out to be faulty and I returned it recorded delivery. After emails went back and forth requesting refund and his excuses for delays in payment, (he is no longer a registered seller) .
I opened a paypal dispute on 1st Nov, I presumed paypal informed him that it had been opened, but now wonder if I should have told him myself, there has been no response.
Also how long do I wait before escalting the claim, I thought 10 days and do I tell him I am doing that

Can anyone tell me if PayPal charge when you escalate a claim?
I have to do one within the next few days, but as it's only for a small amount, I don't know if it is worth it.
If they do, do they recover the amount from anything they get back from the seller or do they charge it to your account and make you pay it?0 -
Ebay charge, paypal shouldn't.
For example, if you'd paid by cheque and done an ebay dispute, you'd lose £15 from your refund.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

I have recently escalated a claim and I remember a charge of $25 was written somewhere in the bumpf. If it comes to it I have no intention of paying it (unless it's taken from my refund:mad: ) as I bought an item which was listed fraudulently on an innocent Ebayer's account. I think this is known as "hijacking". I had a standard email saying the matter was being referred to the relevant department. I have replied to the email letting them know that I have informed BBC Watchdog* about my situation, in a vain attempt to get PayPal to pull their finger out.:rolleyes:
*Watchdog did a report about Ebay on its programme yesterday which is referred to on this site, sorry don't know how to insert a thread.:o0
