CC chargeback loophole??

Perhaps someone can help? I bought goods online but they didn't turn up. I requested a chargeback from my CC company but they said that the transaction was via Nochex (unknown to me) & there was no dispute with them. Both my CC company & Nochex have refused to do anything to recover my money.

Any bright ideas? I'm stuck!

    Was the cost of the goods over £100? If so, the credit card company is jointly liable with the retailer under Section 75 of the Consumer Credit Act 1974. They may try and fob you off, but you need to be robust.

    Try phoning the financial services ombudsman - they offer useful practical advice.
  • No - they took £57.96 from my card (which was actually more than the total cost of goods on their site). It seems that this company (Tukha) have a record of doing this. It sounds like they might be able to get away with it if amounts below £100 are involved?

    Your only other option is pursuing the company itself through the small claims court. Are they an English or foreign company?

    Frankly for the amount of money involved, you may find it not worth the hassle of issuing court proceedings. However you can still threaten them with proceedings and see what happens...

    if the item is on your credit card statement then tell the cc company the goods have not been delivered and to place the item in dispute as you refuse to pay it

    they will probably credit you even though it is under £100
