Having trouble returning a faulty iPod to Argos

Well looking at it from Argos point of view and also under SOGA, iPod in protective hard case, case shows no damage, ipod was secured inside case when given to customer, customer has sat on it and broken it, Fault not inherent, customer "trying it on".
By all means the consumer has the right for the item to be inspected under SoGA for retailer to prove ipod was damaged by consumer. Easy way to do, check packaging, if fine then consumer at fault.0 -

Except that doesn't prove that it wasn't undamaged when the customer got it. It could have been damaged by the bloke in the factory and slipped through QC.0 -
The onus is on the retailer to prove you damaged it. Saying that it was probably you who damaged it isn't proof. For that they would have to have eye witness or photographic evidence of you breaking the iPod, since they won't have that I can't say how they can prove it was you who broke it!0

The Foxcon factory is a hive of technology, aside from the issue that they employ workers in horrible condition, its one long human conveyer belt. If it was a minor thing then yea could of slipped past the workers, but a cracked screen would of been seen by anyone.0 -

They don't have to prove you damaged it, they just have to prove it wasn't faulty when sold, which in the same way is hard to do. But a cracked screen just about anyone would say its the consumer at fault.0 -
So you are basically saying that it's impossible that any product can be damaged before it's sold and thus the consumer is always at fault then. Might as well put the SOGA in the bin.0

impossible 100% yes, but all ipods sold in retail (aside from classics) use the same packaging, a transparent plastic box with the product firmly secured with the screen in full view. A big crack down the screen should have been noted at sale, very easily.0

if this is a ipod touch ? not sure about about other Ipod products ? , then even though its in a hard case there is a sticker over the top of the ipod screen that has the effect that the ipod is switched on showing apps etc,
Its not until you get home and take it out of the packaging and remove this sticker from the ipod touch screen that you can actually see the ipod itself !!!
So it may not have been obvious it had a cracked screen as the sticker was hiding it !!0 -
Oh come on! A cracked screen is unlikely to be an inherent fault.
If Argos supplied the device with a cracked screen... then surely that's pretty much a textbook example of an inherent fault!
Without any of us having the facts, it seems a bit rude of many posters to assume that the OP is lying because Argos are infallible.0 -
If the box was dropped in the shop and it landed flat without breaking, it's possible that the shock could have broke the screen.
At the end of the day Argos should give them the benefit of the doubt and replace it.
Why do so many people on this forum accuse people of lying, they must lead very sad lives or be terrible liars themselves.0
