How does one take a bank to court?

    I'm guessing it's to do with their previous thread from 18 months ago where they had a £15K overdraft converted to a business loan and the bank only pursued them for the money after the business folded and their business partner moved to Brazil.
    My posts are my own opinions based on my experiences and info gathered from sites such as this.

    One first establishes if the bank in question has broken any law whether criminal or civil.

    If this is the case, and criminal law has been violated, then one would inform the authority charged with upholding said laws, i.e. the police. If civil law, then one would instruct one's solicitors to begin proceedings.

    If no law has been broken then one's only option is to whinge about the unfairness of it all on an internet forum.
  • Many thanks for your help guys ... It transpires that the loan of £20K was offered to our company ... to negate the overdraft ... the details (interest rate, period of loan etc.) were drawn up and given the big thumbs up by the big cheese at the bank then the paperwork was posted to us to sign, which we DIDN't do! In the mean time £350monthly was debited out of our Business Account for the next 3 years. (Until the company closed, my partner vanished and I finally [and stupidly I know!!] looked into this debt and stopped the payments!)

    To cut a long story short, I've complained about the fact that neither of the partners signed the loan but I've offered to pay the £3,500 outstanding from the original £20,000 but they want the whole £34,000 (Now £17,500 remaining) this includes the 7 years of 15.4% interest minus the 3 years of payments, the company made which is £16,500!

    Does this make sense!
  • I want to start legal proceedings, small claims or something ... so they see I'm not going to just take it. I'm hoping that a judge would see thing favourably and get this monkey off my back!!

  • The bank says we must have signed something or they loan wouldn't have happened and 'why would we have allowed the monthly payments for so long' ... I've asked them for the last 6 months to show me a signed copy which they cannot do!!
    My hunch is that one of the account managers just fancied his bonus/or just needed to meet his targets (bless him) and got over enthusiastic!
  • Charge them with an unauthorised loan i guess!
