how to sue employer stop my incoming illegally

I'm still employed but the company unfairly to stop my incoming totally now and they even hold my private insurance claim form without sign .(I have private insurance to protect my incoming) .
I have suffering quite a lot for these harassments and my health is effected severly.
I don't know whether I should sue them stopping my incoming illegally which could be crime in another court which is different from tribunal,my discrimination case already in tribunal but my solicitor told me my case could be a year longer in tribunal , But everybody needs survive,isn't it?
My solicitor covered by house insurance ,he told me he is only covered for tribunal case . that means if I need another claim,I need another solicitor I don't know whether I have to pay for solicitor ..But tribunal will have hearing for my case soon, I don't know whether it is still necessary to open another case?or just waiting tribunal judgement.Thanks for potential assistance.

  • Sorry are you saying your Employer is illegally stopping money from your income? Unlawful deductions that you have not agreed to?

    I think what he means is the employer is refusing to sign a form on some kind of income protection insurance and that income protection insurance provider won't pay as a result

    OP, if you could try explain a little more. What form is the employer refusing to sign, and don't quite know why your not working? Is the insurance, Income Protection Insurance, PPI (private protection insurance) or Accident and Sickness insurance.

    Ok, My case actually is longer case.
    The company wishes to get rid of me due to a personal relationship broken with a senior high level manager, It isnot nature redundancy , since I as sales executive did successful job and generated millions pounds revenues for this company and sales revenue grow year by year which is extremely good year in 2010.I worked for this company since 2005. Here I just summary a little bit of my story
    (1) Since January 2010,I was demoted to report to a lower level manager, and constantly be picked up by this new manager, it doesn't matter how hard you do the job, even you sales increase,this guy can say you let the company lose money, even you worked day and night include weekend in a business trip , this guy can say that you didn't work hard enough.my job constantly feel throated.The high senior level manager told me you could be redundancy soon.Then I got legal advice, I have to raise formal grievance . Then I also suffer from work related stress and off from job due to stress related sickness since 1st of June 2010. In the grievance period, Once I also wishes to back to work after the sick notes expiry, but the HRM let me stay home while I can get full pay till the grievance period finish . The grievance period actually lasted till 17th of Sept.2010(it is Friday evening I received the final outcome from the company-, ).Then I also had a holiday in September which break my sickness period. the company also let me stay at home till grievance finish while I still can get full pay which is in writing. My work contract also wrote, I can enjoy permanent health insurance benefit, while my sickness also caused by work related stress which wrote in the sick notes, But till 1st of Nov.2010, the company started give me SSP ,SSp normally can last for 28 weeks , but my SSP only lasted for 8 weeks, till 27th of December ,2010, they stopped my full payment. Today I just met my solicitor, my solicitor said you have your company permanent health insurance, you shouldn't have private sickness insurance, I said ,maybe it is mistake I apply for the private sickness cover insurance, since at that time,I didn't look for my work contract in detail. so actually I have both private sickness cover insurance and a permanent health insurance through the employer, but Now the company unfairly stopped my incoming, The HRM told me in a meeting in October last year, she let me not worry about the sick payment, since I didn't get continous 6 months sick yet, I had a holiday in September as well which break my sickness period.But they suddenly change their idea becuase I go to legal way but they started redundancy /consultation period with me already since October 2010 as soon as finishing the grievance , of course I need to go to legal , it is my job ....I can't back to work If I didn't solve all these stressful issue--I'm not nature sick, it is work--related stress , they stopped me back to work actually.
    In summary,
    (1) I should still entitled to have full payment of my salary since I didn't have 6 months continous sick yet. Even I should return back to work after the grievance finished , it should be 20th of Sept.(Monday) .till End of October, it is only one more month, they started to SSP for me from 1st of Nov.2010.
    (2) even I have exceeds 6 months continoues sickness, I have permanent health insurance which written in my work contract, but they didn't apply this for me.
    (3) Now I apply for my private insurance claim which cover my sickness and redundancy,--the company hold it ,and didn';t sign on. ( it is only one page claim form which require employer to fill it ).I sent this form to them on 30th of Nov. they didn't feedback me, then I chase them by e-mail, --then they listed one pages questions --(lots of ) to tease me, these are rediculous questions, such as : what is your job title ? (she is HRM ,but she doesn't know my job title)
    Is this your private health insurance or our company's health insurance .(I told them twice it is my private insurance claim ,If it is company insurance, I don't need to send her the claim form, they will do it for me ,isn't it ?),.--After I read this bully e-mail from HRM on 14th of December, I was so angry and hardly to breath and sent to hospital by ambluence.
    Now my case is in tribunal , Today my solicitor told me, your case is just begining, it is long way to go , it could cost 1-2 years to solve it, but everybodys need to survive.
    My solicitor which covered by my house insurance ,only covered for tribunal issue, not any civial court issue. I don't know whether any civial court could solve this payment issue in quick way ??My case is in tribunal now and will pre-hearing soon. But my employer try to use starving strategy to starving me and my family. Can people who abuse power to starve another people in illegal way in modern democracy society? And I have to wait a year or couple of years long battle in legal way ??
