Hey all,
I sold my mobile phone on a buy it now it was advertised on £99 + £5 p+p, i was emailed by this guy asking for free delivery. I agreed as i had been burned twice by fake bidders and he had 100% rating so i sold it through ebay. He paid and i sent the phone out next day delivery.
he has emailed me 3 times today ( delivered today) firstly saying phone wasnt as described as it had a few scratches on and i had put good/excellent condition asking for part refund. Then he emailed me asking for full refund as he just wasnt happy with this that and the other. And now i have received an email from paypal saying he .
"*buyer*has opened a dispute for the payment made to you on 3 Nov 2006 indicating that the item they received did not match your original
description"
I have never experienced anything like this before, is there a chance he can get his money back from paypal without my say so. there was a pic of the phone on the ad so its clear what condition is was and as far as im concerned its in good condition etc Im also worried that this will be my first negative and will ruin my 3years hard work.
im not sure how do reply any help will be greatly received.

afaik, the buyer always gets refunded from your paypal a/c whether you like it or not, I would hope that they insist that the phone is returned to you before they give the refund, but I am just not sure. I am dreading this happening to us but I have have had a couple of payments from buyers with an unverified address (small amounts), and paypal say to be wary. obviously I would never send an expensive item (especially abroad) without verification but it does surprise me that paypal seem to refund people so easily and there is nothing you can do about it. I bet some people make a fortune with chargebacks for items that supposedly " never arrived". I am fast losing heart in ebay. As in life, scammers and scumbags make life difficult for genuine buyers and sellers.0

A paypal decision could go either way here as 'item not as described' is notoriously difficult to prove either way if the item was not new to start with. What is 'good condition' to one person is 'poor' to another, so just respond to any questions raised through paypal factually and you have a good chance of winning.
If however the buyer did win the claim then he would be expected to return the phone at his own cost, tracked and insured, before the refund is processed.
Did you keep a note of the IMEI number in case he treis to switch it on you?
