New House - Condensing Boiler Flue inbetween floors

Have lived in a new house for just getting on 3 years and last year after the 2 year warranty expired decided to take out a annual maintenance contract with British Gas as it included an annual service. They serviced the boiler but then discovered that because the flue has been routed between the ground and 1st floor there was no way they could guarantee no cracks/all was in order declared it "unsafe" and cancelled the policy. As the boiler was serviced thought nothing more of it until one of mates last week that he had been talking to someone else who reckons this was a regular thing with some house builders and that they would only act when you complained or asked to refer them to the NHBC. Does anyone know any more details about what is / what isn't allowed before I go to the house builder?

Have you got a written statmet from BG stating the flue is unsafe, and why? If not, ask for one.0

Contact your local Buildings Control Officer at the Council and ask their advice first. AFIAUI, where any part of a flue runs between floors it would be usual for there be some kind of access/inspection panel ( there are also min spaces permitted around the flue too)0

Don't know much about this but stumbled across this today....
From 01.01.2011 inspection hatches will become a requirement where the flue is concealed within voids.
Could it be that your home met required standards when built but standards have now changed, hence British Gas won't accept for servicing contract?0
