    Interesting, if the "borrower" goes BR do the shysters go after the poor sap who signed for them?

    The whole Guarantor system is shabby in the extreme and you'd have to hold a gun to my head to make me sign on of those things for a person who's a know bad payer.....which they all are.

    Creating that website is foolish imo, I would take it down now.

    Are you really going to get embroiled in a civil lawsuit with these people, it takes some serious money to defend such (especially a Libel/Defamation suit).

    It definitely does not help any case you may have, you may be angry about the situation but this is not the answer, trust me.

    I spoke to their solicitor who says the website is defamatory but its not. He claims the title FLM Scam meaning they're a scam is something that is Libelous I disagree, If you take someones money your not legally entitled to do and do not pay it back then you are a scam.

    Well, you could point out to their solicitor that FLM Quick are part of the Richmond Group, that the Richmond Group is owned by James Benamor, and that the BBC have described James Benamor as someone who "has made a fortune by misleading people over loans".     That's not to say I think it's a good idea to start a defamation battle with anyone, but I thought that since you're half way there already that might help.

    Im not too sure its a good idea to start a defamation battle if you don't have the resources to outdo your opponent. As that report was in 2008 and related to non guaranteed loans (although its makes reference to FLM Loans) then it wouldn't be the greatest defence.

    Im not saying that FLM are angels, far from it and Id agree that anyone should take the proper route to recovering their monies and if it so happen to cause the company public image issues then so be it. But this is only going to end one way. Defamatory (in their eyes) websites will just get their backs up and they may just chuck more money then they get back to make an example.

    It's sad to see that some of the spiteful posts by FLM apologists on this thread can't see beyond the black and white of this situation.

    I'm not a "FLM apologist", I'd be delighted if all PDL companies closed down tomorrow, in fact (though I'd also be concerned about where people would go for 'loans of last resort' instead).

    But if you want to talk about "black and white", you can't ignore the fact that the OP and their partner made an agreement with FLM, which very likely outlined precisely what would happen if payments were not made on time.

    Thanks for the kind words, the legal battle just to point out is about the Harassment of a Bankrupt not that of libel. That was FLM Quick's solicitor trying to get me to take the website down. He was referring to the word ("SCAM")

    A Dictionary meaning of scam is
    a stratagem for gain; a swindle
    vb scams, scamming, scammed
    (tr) to swindle (someone) by means of a trick

    Considering they have never given me anything I should not be paying for anything. The Scheme is a trick hence its a scam so the statement is true.

    You then have to look at the reasons why the OFT Minded to revoke the Groups Consumer Credit Licence (For Misrepresenting their products or services) i.e. Scamming customers.

    Let them sue for Defamation the libel laws are a lot tougher on ("Claimants") than they used to be. Chances of success are very small to that of years ago when libel was the thing that all big shots went after.

    I reviewed all evidence before going along with the website.I have got email evidence proving they have lied

    The BBC is an interesting story and that of the Mirror investigation that also claims them to be a scam.

    If they want to sue me then they should have sued the BBC and The Mirror.

    Difference is that the BBC and The Mirror can throw a few hundred thousand defending a libel case, can you?

    Your evidence would be best put through a lawyer/solicitor before starting such a website, what has your legal council advised regarding this website?

    Again, just playing devils advocate, but Ive seen these type of cases of website creation to get back at a corporation go very badly in my line of work (Im not saying this is right or wrong).

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    The aforementioned website is great btw. Its not just that domain, many of our favourite finance companies also have their own linked domain. :T
  • I was very foolish and became a guarantor for a friend for a loan from FLM. He now cant pay and I have been constantly harrassed by them and they took money which i didnt have from my account without permission. Luckily I got it back as my bank said it was illegal to do that. My not friend now still cant pay and they have said it will go to court now and it has made me ill with the worry. I know it was my fault and regret it but at the time thought he was a good friend and had known him for years. I have some belongings of his and could sell them as he is in two months arrears now. Feel bad doing it but I dont feel that I have any other option and could be in trouble if it goes to court for money that i didnt spend, what an idiot!! Friends say that I should think of myself and sell his things to make the money for the arrears but he will not be happy with that.

    FLM normally only let home owners be guarantors - are you a homeowner?

    If you are you need to make an arrangement with them to pay asap.

    I can see that selling his stuff will help towards the arrears but what about future payments?

    If they take you to court and obtain a CCJ you need to complete all paperwork sent to you.
    The ultimate is that they will apply to put a charge on your house.

    I had a client who was guarantor for their daughter, she split from her partner and could not pay so they chased mum and dad. They took it to court for a CCJ and the daughter returned her form but parents did not as they thought as daughter had done her's it did not matter.

    A forthwith judgement was granted and as they could not clear the balance in full FLM applied for a charge on the property. When I tried to defend it the judge would not allow it and now my client has a charge on their property and they pay £25pm towards the debt.
