dla appeal, sorry

my mother in law was refused dla, to cut long story short i have ended up as her representative, i have wrote a submission showing our reasons for appeal, and we have managed to gain evidence from her gp which states she cannot walk 50 metres,i think this there is enough evidence for her to qualify for dla, the dwp have looked at this evidence and say they still want to go to the tribunal which is next week, i have never been a representative before and although i'm quite good with paper work i'm not so good at speaking in front of a panel, can anyone give me any ideas of the sort of opening/closing things i should be saying, i think i am expected to say something, thanks

    If you have covered what you want to say in the submission there may not be alot that you will need to say. You will be given an opportunity to speak and may want to go through the main points. The tribunal will mainly want to direct questions to your Mother In Law about your Mother In Laws mobility problems and care needs, but if necessary you can support her in her answers. Near the end you should be be given the opportunity to add anything alse you want to, so could at this stage say if you disagree with anything the panel have said during the hearing.

    I would get some advise etc from your local Citizens Advice Bureau or Welfare RIghts service who may be able to advise you on things to say though I would have thought that it will be too late for one of them to come with you to the appeal.

    Sometimes the panel only like speaking to the claimant - in my IB tribunal thing they only spoke to me and when my representative tried saying some stuff he was told they only really wanted to speak to me, there was a time when they let him speak but not for long!

    Hi

    My mum represented my uncle at his DLA appeal after he'd been turned down completely. My uncle was so nervous, he sat in the car waiting with his son whilst my mum, who was just as nervous really, attended the tribunal. The tribunal clerk asked the panel if they would accept my uncles absence on the understanding that should my mum be unable to answer any of their questions, someone would ask my uncle to come in - they agreed to this. In fact, the panel only studied the written evidence and were able to award both HR mob and HR care - neither my mum nor my uncle had to speak.

    I guess this doesn't really give you any ideas on what to say, just wanted to demonstrate that not every tribunal insists on (a) speaking to the appellant or (b) speaking at all.

    I'm sure the appeal panel would appreciate straight forward, no frills talking - they'll have come across every approach in the book and will treat each one alike anyway.

    my mother in law is more nervous than me, i'm trying to tell her it'll be doddle when really just the thought of it has me shaking in my shoes, thanks for the support everyone, i'll let you know how it goes

    aw god three days to go, i have an eye infection, had mother in law on phone telling me she didnt want to do it in the first place, and just had hubby telling me she is bricking it, dwp have said they confident in their doctors report.cab cant see me till after the tribunal, god help me please!

    Honestly it will be fine.
    the good news is that there is a much higher rate of success if someone physicaly goes to the trib.
    All they will do is ask for clarification of anything they are unsure about.

    it really winds me up:mad: to think that we all get in such a state (me included) when going through these things these people are only humanm they f**T and wee the same as us :rotfl: i wish i could be on a panel from the other side and i would be sooooo nice to people i think they like to see who squirms the most:rolleyes:
