Lateral Thigh Trainer Not Acceptable - What are my rights

Wife bought a lateral thigh trainer about 6 months ago and used her credit card. Was internet based company. Anyhow when first delivered main casing was cracked, etc. and after a few emails the company sent the replacement bits. However it did squeak when being used but assumed it would ware itself in. However this has never gone away and its now unusable unless you have a set of headphones on!! Just about to send the company an email asking for a replacement or a full refund, but just wondering what my rights are and if anyone has any special tips.

for the first 6 months, it is down to teh seller to prove tha the fault did not exist at the time of sale. after that, the onus is reversed. Goods should be as described, fit for purpose and last a reasonable length of time. It could very well be argued that you have accepted the goods, given the length of time you have had it, so i would certainly expect the company to offer a repair, but i doubt you would get a refund.
when complaining, best thing is to be polite but firm. Flatter the company ("I so much enjoy buying your products and am surprised that this has happened as you are normally so wonderful blah blah blah") and make a veiled threat I trust that this can be resolved amicably without the need for legal action, and that I can continue to enjoy buying from you in the future etc.").
I use a similar format in all my letters and I rarely have to write in more than once.Don't bother trying to sue me - I've got no money!0
