Not sure how to proceed with this

I ordered contact lens on 5/12/10 online and to date have not received this from the supplier. I have contacted them several times and for most part they just keep telling me my orer will be shipped within 1-2 working days. When I threatened to contact the police they told me we have shipped it. This was at the beginning on Jan but as I said I still not have received it. I have asked them for a refund but they refuse it. What do I do now? Do I contact my credit card company for fraud?

    It's been 30 days since you agreed the sale so they have defaulted on the contract of sale unless it was stipulated at point of sale it may take more than 30 days to complete.

    As such, you are legally entitled to a refund. As the purchases was under #100.00 (I'm guessing) you aren't covered by S.75 of the Consumer Credit Act, but if you used a VISA card you may get some leeway by asking the card provider for a chargeback. No guarantee though.

    The same option is available with Mastercard (and Amex).

    The transaction was for £105 so how to I proceed with a S.75? Would the police do anything?

    You'd be covered under s.56 aswell

    I dont think the police would be interested

    Phone the credit card company - tell them the amount and date of transaction.
    Advise them that the goods have not been received and tell the advisor of what you have done to chase the order up.

    They should then either arrange to refund the cash back to your account or send you a form to confirm the details = then they will refund.

    If it is an EU company they are required to allow you to cancel and refund you in full under the distance selling regulations (unless the lenses were custom made- I am not sure if contact lenses are).

    No, contact lenses aren't. They come stock in all the various strengths etc. Does sound like S.75 claim via the card issuer is the best way to proceed. Good luck!

    I just ordered 32 pairs of daily disposable lenses for #9.98. Hope they're wearable!
