Beware: TUKHA charges but doesn't deliver!

I ordered a microwave online from TUKHA (trading name of IA Solutions Ltd) in August after finding them via a search site recommened by MoneySavingExpert.com. I emailed TUKHA when the goods didn't arrive (their phone-line never works!) & they replied that they couldn't source the microwave anymore. I replied that I therefore wished to cancel the order & would like them to refund my credit card. That was the last I have heard from them even though I have tried emailing & calling on many occasions.

It turned out that 'Nochex' actually charged my credit card & paid TUKHA (I didn't know this when I ordered the microwave). I've contacted Nochex & complained to them. They basically told me they couldn't help as this was a dispute with TUKHA (although they did try to contact them). I then asked my CC company to charge back to TUKHA - but they refused as they said the charge was to Nochex, not TUKHA. I went back to Nochex who suggested contacting the police! According to the feedback on 'PriceGrabber.co.uk', I'm not the only person to have fallen foul of TUKHA (see the link: http://www.pricegrabber.co.uk/rating_getreview.php/retid=4628//).

I'm now stuck! Can my CC company really refuse to charge back because Nochex was involved? Why is TUKHA still allowed to trade & get away with this as it's obviously been a consistent pattern?

  • My understanding of NOCHEX is that refunds cannot be made. It's a safe way for the seller but buyer beware. Have you read the T&C on the nochex website?
  • The strange thing is that I was unaware that Nochex were involed with this transaction until they appeared on my CC bill. Sounds strange but it's true. It also means that this could be a nice little scam where web 'sellers' are protected from such dodgy dealings - something needs to be done!
  • Allot of ebay seller re using NOCHEX because the buyer cannot do a charge back or have a refund the same as if they used paypal. So yes the seller is protected but not the buyer. It cuts both ways really as Nochex protects the seller from buyers that receive the goods and then start complaining and wanting their money back and winning their refund through paypal when they have had the goods all the time. Have you contacted trading standards at your local council for advise on this, it may be a good idea to do so as you may not be the only buyer who has questioned this company. They should also be able to give you the advise you need on who gives you the money back. My understanding is your agreement is with the seller not NOCHEX or if they wont refund you then you can also consider a small claims court summons, the chances are they will back down and pay up immediately including your court costs. Write them a letter sating you request a full refund within 14 days or you will file the papers for court, should shake them up and get them moving but don't feel there is nothing you can do here, there is actually quite allot. Good luck.

    EDIT as for the Police you could pop down to your local station and ask for advise but to be honest this will get put to the bottom of the list, unless of course you live in an area where there is hardly any crime and the officers don't have a great deal to do. Yes there are such places, quite a few in Wales unfortunately not where i live :)

  • I had the same problem with Tukha.

    No goods, took payment..............it took me 2 months to get a refund from them despite being told they would refund immediately.

    I only got a refund when I threatened to make a personal visit to their registered offices!!!

    NEVER USE TUKHA AGAIN.

    You could file a claim in a Small Claims Court against IA Solutions Ltd. Write to the address listed by Companies House for the company notifying them that you will be taking legal action in 14 days if a refund is not received. Send the letter recorded delivery.

    Possibly a resolution to this via SafeBuy. - I mailed SafeBuy & they've just 'communicated' with Tukha. Guess what? Tukha mailed straight back saying they'll refund me by Friday! Watch this space...

    TUKHA also promised us a refund by today ............. still waiting :confused: Hope you have better luck!! btw TUKHA told us that Safebuy are nothing to do with them and can't do anything about it... we'll see!
