Can i claim HA while living here!

Hi all,

will be having to leave my home in around 3 months tim,however i am currently claiming housing benefit,my question is if i moved bak to a relatives on a temporary basis could i still claim HA as i am not going to have a permanent address until i find a private lanlord due to my bankruptcy.


any advice most appreciated.

    Short answer is no. You cannot claim HB/LHA while lodging with a friend or relative as you will not have a tenancy agreement.

    It's nothing to do with having a tenancy agreement. As far as I know you can lodge with a friend and claim Housing Benefit (as long as the person isn't actually your boyfriend/girlfriend).

    Housing Benefit rules state that if you are living in the home of a close relative and they live there too you are treated as though you are not responsible for paying rent even if the person has asked you to. If your relative is or wishes to claim then they can claim but would need to add you to put you down as part of their household. The Council will then assess with you as a non-dependant.
