FSO Claim - Axa being stubborn

Some time ago I mentioned that I found it necessary to file an FOS complaint against Axa.
Briefly, wife bought a used car and dealer "threw in" a 12month mechanical breakdown policy from Axa. Within the 12 month period there was a mechanical breakdown which necessitated £900 in repairs. Claim made, and rejected by Axa’s claim management company on 5/8/10. Cue complaint procedure. Final response from Axa on 1/9/10. Cue claim to FOS in late September. Case is assigned to an “adjudicator”. Adjudicator gets both sides of story and agrees with me that claim should be honoured. Axa makes a couple more objections and, based on these, adjudicator sides with Axa. I demonstrate that these objections are inapplicable and adjudicator decides that claim should be paid after all. Last week I get email from adjudicator saying that Axa still won't agree to pay claim and that she has no choice but to prepare a case for one of the ombudsmen to make a binding decision on. Lord knows how long that will take.
If anyone needs an example of a situation where some kind of fine would be appropriate - there's one. (Assuming the ombudsman agrees with his adjudicator that the claim should have been paid.)

In October I received a telephone call from the police in a house that I rent out in Leicester. They had carried out a search and found 21 Cannabis plants growing in one of the rooms. They had arrested a guy who was not one of my tenants in the house. I was interviewed by the police and then met the loss adjuster on site.
I have now evicted the tenants and had the property repaired. There is a new tenant. In early November I sent to the loss adjuster (Crawfords) the tenancy agreement and the gas certificate. I then heard no more. Just before Christmas I wrote to the insurance company threatening them with the ombudsman but did not get a reply.
Finally I wrote to the insurance company again heading up the letter COMPLAINT stating that I would pass the correspondence over to the ombudsman. I heard no more and faxed a complaint to the ombudsman on Friday 4th March. On Friday 11th March I received a telephone call from the complaints section stating that my complaint had just landed on their desk. Today I got a letter stating that the FSA give them 40 days in which to respond to complaints. Well they have already had 20 notwithstanding the letter that I wrote at Christmas.
This company really is the pits.0 -

I'd have filed a small claim with moneyclaim.gov.uk. The delays in the FOS are longer than the court system, and you don't need a lawyer if it's assigned to the small claims track.0
