jsa1 `Partner Living with you`Req single claim for partner

Hello--I am new to benefit claims and this site so apologies if this is in the wrong place, any help is appreciated. So--on the single persons JSA(S) form it states-do you have a partner who is living with you--my partner and I have seperate premises and are on the electoral roll in different towns--council tax bills and other bills-ie elec, gas, are in are own name at each dwelling (except for the telephone, because I use the net at her place so I pay-bill in my name at her place) I am not on the rent book at her place. I would say that a lot of the time I stay at her flat but sometimes I stay in my house where I have a Lodger (on electoral roll there).Would she be able to claim single job seekers allowance? or would we be considered as a couple living together-- or would I have to spend 4 nights at my house(she could be with me) and 3 nights at her flat so that my main place of residence is my home therefore we our not considered as being `A person you live with as if you are married to them` A yes to that last sentence is no good to me as I have a full time job. I only wish to claim for her on her own. Will I have to do the 3dy 4dy tiresome shuffle (have nosy neighbours) or am I ok as I am or will it damage the claim? Thanks.

there is no 3 day/4 day rule!
i'd say that even though you have a residence each, the fact that she is either at your place or you are at heres does look as though you live toegether.
the bill in her address with your name would also seem to point to this.
do you shop for food together?
    do you eat together?
there are many factors to consider. not just where your named residence is

You cant claim as a single person for her - she has to claim herself.

And like stated there is no one defining factor that governs living together decisions. The permutations are numerous and the 3 or 4 day notion is a fairly laughable one.
  • mmm thanks for reply--I am a working partner and supporting my own place and bills. Obviously my partner is not working so that leaves me with two premises to support. If we only had the one dwelling (+one set) of bills I could understand jsa not being entertained as my wages would support us under the one roof.Any mor views welcome. Ta Bobby.

Thanks---I wouldn`t be making the claim she would.

Is there any reason you can't move in together anyway Blobby? It seems like you live togther full time, just at either yours or hers, so it seems it would make financial sense to spend all your time at either hers or yours and let go the other place.
