money deposited by mistake

hi this is my first time on here but i do not no who else to ask this question - i had £3k deposited into my bank account a few months ago - i was waiting for some money to come through so i thought it was mine so i spent it - i have now realised it was not mine to spend and i do not know where i stand with this - do i have a leg to stand on ? i am so cross that i am at the minute £3k in debt

  • How much was the money you were expecting?

    If it wasn't £3k, then shouldn't this deposit of rung alarm bells?

    Also, did you actually receive the money you were expecting? Can this not be used to repay the £3k, or have you spent this as well?

    The bank will take it back out of your account at some point and you will be -£3000 then your going to end up with charges on top of charges so you will no doubt end up in debt way more than £3000.

    The money was never yours and in fact spending money you know is not yours can be illegal. Although its not something that typically gets pursued if you pay it back and the amount is small. There is some consideration if you reasonably expected the money to be yours but its a hard to one to prove. Especially if the money you expected turned up or was nothing like the amount in question.

    The best you can hope for is that they agree a repayment schedule for you to pay it back. Something along the lines of 12 months worth of payments.

  • Thanks for all yr replies - first off the money i was expectin is NOT now goin to come through an it was in the region of £3-4k from criminal injuries - i know the bank can not take it back after 24hours of being deposited and it wasnt the bank that put it in there it was a company payin a bill but must have got some numbers wrong in the transfer? i have been honest with the bank an even gave permission for the company to speak to me, which i did and arranged a payment schedule with them - i am an honest person an i would not have spent it if i knew it wasnt mine to spend - i should have checked first where it was from but i just assumed !!!!! i am single parent with 2 children an now wit £3k to pay back - i feel so stupid that i just assumed but i suppose we learn from our mistakes - better start payin it b4 i end up in court lol

    Forgive my ignorance, but would you not expect to receive some written confirmation of the settlement from the court or your solicitor before assuming that money paid into your account was this?
  • I did not have a solicitor an it wasnt bein dealt with in court - i was informed that it would b transfered as they had my bank details - but yes i would expect some confirmation of the settlement ? i have never dealt with anything like this b4 and when this money was in my account i just assumed it was from them an i was so excited i didnt check -
