Poss IPA query

Afternoon,

My OH and I went BR in August 2010 and he had a NT IPA put in place. He has recently got a pay rise and possibly will put us into surplus on our soa. I am in the process of updating our SOA to send to the OR but just wondered, if he has an IPA put in place, would he be assessed under the old or new guidelines?

  • I may soon be in the same position, also br last Aug.I think any new ipa is going to be assesed on new rules but not sure as it seems a bit vague. I have filled in forms for early discharge before christmas but may soon have a slight payrise in the next couple of months so will have to do a new soa then so I would be interested in the answers you get to your question.

    I believe it would be under the new rules as its a new IPA, the original one is just to collect the tax and I think that would continue seperately.
  • Has anyone br before the new rules came in had to fill in a new soa for any reason and been assesed on the new rules as yet?
    Would be interesting to know as it still all seems a bit vague. I know some people say the new rules apply to new ipas but has it affected any one br before as yet.

    So does that mean they will still allow £99 surplus before a ipa if you went br before he new rules I wonder?
  • Hi all, if you go on the insolvency service website they have an updated bit under latest news - if I have read this correctly then BR's before the 1st december are treated under the old rules "as it says existing IPA's or variances of it will be dealt with as before" take a look as I can't post links.

    Think it means that if you dont yet have a ipa but have a change in circumstances and are then reassesed you come under new rules or am i reading it wrong?
  • Hi HU&FU, a matter of interpretation I think, which muddies the water as I read it one way and you the other, which leaves us back where we started ? I for one am hoping it is the "old rules" as I may be affected with csa payments {however I have another argument going on this one - but I shan't muddy the waters any deeper with that !} Oh roll on the summer is all I can say right now. MC xxx

    Oh btw, I have to add I have a nil tax code applied for the grand some of 1.50 per month, but have not heard from moonbeaver at all?????? so even muddier waters????

    I hope its the old way too could well be the way im reading it so will leave it for someone else to see what they think

    Sections 4 & 5 makes reference to new IPA's from 1st December, and also states that if IPA in place on 1st December then it continues under the 'old' arrangements.

    As it specifically mentions IPA's in place, rather than makes reference to a BR date, I'd go with IPA date.
