Landlord not paying Mortgage on house I rent

Hi All, new to here.
ok I'm wondering if anyone else has experienced this. here is a letter i have sent to my solicitor.

I have rented a house (the property) in Kent for 3 years from Martin & Co (the agent).

The agent has been unable to contact Mr. Smith (the Owner) for over 7 months.

The owner has not been paying his mortgage on the property.

The Owner has an incorrect mortgage on the property to offer a rental.

Northern Rock (the lender) has set a court date for repossession on the property.

I would like to live there for as long as possible and not pay the agent.

I would also like my deposit returned by the agent.

I would like to approach the lender on the possible purchase or rental of the property.

I am unable to pay a deposit but would happily take on the mortgage after I have been paying it for the last 3 years.

The lender wants approx £23500.00 to clear the debt.

I currently pay £950.00 a month for the property to the agent.


I think this covers it.

any advice greatly accepted.

  • Hi there, sounds like a bit of a mess and unfortunately I don't think it's as straight forward as you buying the place/taking over the mortgage. Hopefully someone else will be along to advise more soon.

    I really cant see what your solicitor can do, the only persons who will be able to help is the LL or the lender, and they wont be able to sell it to you, they also need to find the LL
  • Sorry to read your story..

    I'd write & ask agent if he has been passing money on to landlord. If he has then agent knows where landlord is, if not then ask for your money back...

    You can't just buy a house by "taking on the mortgage" - particularly for only £23k!!! The lender has to first reposess the house and sell it for the best price they can. If you want to buy it you will need a large deposit and your own mortgage. The lender may be willing to rent to you for a while though.

    The lender has been passing on the money, but have had no contact with the LL, and are unable to contact him.
  • Hi and thanks for your input so far.

    over a few pints in the local where the landlord was most distressed about the fall in revenue after we leave, he reccomended facebook.

    Would you believe it, we found him.
    My girlfriend changed her profile pic and added him, at 1am he comfirmed the friend request. I added him this morning and hopefully I will be able to talk with him.

    Not sure now if he steps in and pays up what would happen.

    artful lodger, I looked through past threads and found that shelter advice link and it was most helpful, thank you very much.

    I am going to change my letter I drafted to the solicitor, and contact the Lender to get an extension on the tenancy aggreement.
    at best I can get another 2 months.

    this is such a mess.

    Whistling in the wind mate on all accounts...

    Start making arrangements to find somewhere else to live and if you want your deposit back returning the property to the state of repair you took it over in.

    just walk away, dont pay a further penny and move on. In fact just squat for a few months rent free

    OK, that makes more sense!! But you still would need your own mortgage and deposit to buy.
