Not received payment

I sold an item on 22nd Oct, buyer paid through paypal into my account but i couldnt accept due to it being a basic account and didnt want to upgrade, so i sent the buyer an email just saying I was unable to accept payment as explained, and could we arrange another payment method. This was almost 3 weeks ago; I have emailed the buyer on a couple more occasions but still no replies or anything. Where do I stand now? Should I look at NPB or as he has attempted to pay is this not appropriate?

If you ticked the I accept paypal box then you should not have returned his payment, as you were wrong, not the buyer. Normally when we get questions from the buyers on here I would normally recommend that they do not pay using any other insecure payment method, as it is a common scam to advertise paypal and then refuse it for some reason or other.
If you open an nPB the buyer will almost certainly respond with a non performing seller complaint which depending on your ebay history and overall feedback might be a problem for you:

Personally I would email the buyer politely, either suggest that you will now upgrade to accept his payment, or ask him whether he might consider paying by a different method. Basically though if he refuses to pay unless he can use paypal you are stuck.
Obviously, if you di dnot have the I accept paypal box ticked, then you should stick to your guns as no buyer should assume a seller takes paypal unless it shows as an accepted method on the auction.

On the listing it says that paypal is accepted and it also says personal cheque. I sent out an invoice when the item ended explaining about my paypal account being a basic account and only accepts payments from funds already held in paypal accounts.0

If you say you accept paypal then you must accept it, you cannot refuse to accept paypal funded by a card.
In future if you don't want to accept card payments then untick the I accept paypal box and merely put in your listing that you will accept paypal funded only by an existing balance transfer. It's best not to accept bank transfer via paypal as that can trigger the need to upgrade as well. That will mean that your auction won't show up when people lik eme search for aucitons that accept paypal, but it will stop your buyers starting a non performing seller complaint against you.
Regardless of what types of paypal payments you accept it is perfectly OK to offer cheques, postal orders etc as payment methods as well. However you cannot accept paypal and then refuse it as your terms and conditions cannot over write those of ebay.

I would assume because of the fees, that is the usual reason people try and work round the system with a basic account.
